Study On Government Role In PPP Project

Nowadays,the PPP project has been in a very important position in the economic transformation and development of our country.As one of the subjects of the PPP project,it is very important for the development of the PPP project that the government plays its role well.Therefore,It is of great significance to the study of government role-playing.Based on the current failure cases of PPP project in our country,This paper tries to find out the reasons for the government's role-playing errors in the practice of PPP projects,subsequently,through comparative analysis of relevant theories and relevant experience at home and abroad,In view of the aforementioned points of failure to put forward their own recommendations.This paper is mainly divided into four parts:The first part,overview of PPP Project,Introducing the concept of PPP project and then introducing the main body of PPP project,namely,Social Capital Party and Government,Then it introduces three mainstream theories of government's role orientation in PPP projects.The second part,on the basis of the first part of the theory,briefly describes the role orientation of the governments of the United States,Germany,France and other typical countries in the operation of PPP projects,and draws good experience from it to provide arguments for the views and suggestions in the following chapters.The third part,this part will elaborate the reasons and problems of the unclear role of the government in the operation of PPP projects in China,mainly from three aspects of legislation,practice and supervision.In terms of legislation,the main problems are that there are gaps in relevant legislation,contradictions between different legislation and over-principled legislation.In terms of practice,it mainly talks about how the government should play its role well under the restriction of law.In terms of supervision,there are mainly two aspects of social and judicial supervision,including inadequate information publicity,which makes it difficult for the society to supervise and judicial supervision is inadequate.The fourth part,put forward suggestions for the third part and expound their views in the suggestions.That is to say,in PPP projects,the positioning of government role should be differentiated according to its different behavior characteristics at different stages of PPP projects and the different objects it points to at the same stage,rather than generalized.The suggestions in this part mainly aim at solving the problems of legislation,practice and supervision on the role orientation of the government at present.In terms of legislation,firstly,we should make professional legislation,put forward legislation for PPP project agreement,and fill the gaps in relevant legislation.In addition,we should pay attention to the legal rank should be high enough;secondly,sorting out the relevant legislation and removing its legislative contradictions.In terms of practice,firstly,the government is required to play its role in accordance with the law.Secondly,Governments need to be able to identify their roles at different stages.In terms of supervision,Firstly,in the aspect of supervision,we should establish information publicity system and formulate detailed publicity rules to ensure that information can be publicized accurately and timely.Secondly,To clarify the importance of judicial supervision and regulating the role of the government.through the above ultimate goal of accurately positioning the role of the government.
