Under the background of building a service-oriented government and promoting social organizations to participate in coordinated governance,the power of social organizations is growing.Taking history as a guide,it is of great significance for the government to learn from the legislative system and law enforcement practice of social organizations during the Republic of China to improve the contemporary social organization governance system.Hubei Province as a hub for land and water transportation during the Republic of China,civil organizations are very prosperous and developed,forming four basic forms: political,economic,public welfare,and cultural and sports.The Hubei government of the Republic of China regulates and manages social organizations from both the legislative and law enforcement aspects.In the legislation,not only through the central level of legislation such as the Constitution,civil law,criminal law,the "Organization Law of the People's Organizations in the Extraordinary Period" and the "Organization of the Correction of the Organization of the People's Organization",the social organization is managed.The local government has also introduced the "Republic of China." The basic laws of social organizations such as the Draft Ezhou Provisional Law and the Rules of Business Donation and the legal norms related to social organizations have formed the legislative dimensions at the central and local levels.Law enforcement includes a series of measures and means such as determining the competent authority,registration system,taxation management,miscellaneous fees collection,compulsory collection,etc.,which have obvious characteristics of temporary,violent,and utilitarian.The Hubei government of the Republic of China has certain positive significance for the legal regulation of social organizations.It is reflected in the "anarchy" of the Qing Dynasty.The management consciousness of the Republic of China has been greatly improved,and the two-tiered legal system has also played a certain role.The role of normative guidance has severely cracked down on traitors and maintained social stability.Negative aspects are manifested in the blow to the red organization,the exploitation of economic organizations,the impediment to economic development,the over-regulation of regulation,the rigorous enforcement of laws and the low legal authority.The legal regulation of Hubei social organizations during the period of the Republic of China has certain reference significance for the management of today's social organizations: First,we must improve the legal hierarchy of social organization legislation and formulate the basic law of socialorganization.Secondly,we should establish a filing system and include social organizations that do not meet the registration criteria in the scope of filing management,and thirdly,we should liberalize the direct registration system and include charitable organizations in the scope of direct registration,in addition,we should improve the entry threshold and strengthen supervision,and finally,we should perfect the tax preference system in order to maintain the freedom of the Association Strengthening the encouragement and protection of social organizations and standardizing and guiding the development process.
