Research On The Openness Of Government Affairs From The Perspective Of Administrative Law

Openness is a requirement of modern democratic politics.In the administrative law,the principle of administrative openness exists as one of the basic principles of administrative procedures,and the openness of government affairs is one of the administrative procedures,running through the entire administrative power.The openness of government affairs has played a positive role in realizing the supervision of government power and safeguarding the rights of citizens.The government information disclosure is the basis of government affairs disclosure.With the development of society,people's awareness of democracy and legal system has been enhanced.In order to regulate information disclosure,the revised regulations of the People's Republic of China on government information disclosure(hereinafter referred to as the regulations)was promulgated in April 2019 and came into force on May 15,2019.Although the "Regulations" have a certain guiding role in the content of government affairs disclosure,there is still a lack of legislative guarantees for government affairs disclosure.The theory comes from practice.In recent years,the open research on government affairs has shown an upward trend.From the development history of government affairs disclosure,government affairs disclosure is closely related to information disclosure,but government affairs disclosure is different from information disclosure.Different scholars have different understandings of the definition of government affairs disclosure,the relationship between government affairs disclosure and information disclosure.In actual work,the administrative department and the judicial department also have inconsistencies in the identification of specific issues of government affairs disclosure.In particular,local governments are now assessing the openness of government affairs in the region.From the perspective of assessment,they can more objectively reflect the openness of government affairs,and at the same time expose new issues of open government affairs.By participating in the public assessment of the provinces,cities(counties),townships and towns in Jilin Province,and conducting investigations on the openness of government affairs in other provinces and municipalities,the disclosure of the current public affairs is not clear,the open standards are not uniform,and the public effect is not obvious.From the theoretical and practical aspects,it analyzes the status quo of government affairs disclosure,and puts forward suggestions on the scope of government affairs disclosure,information disclosure standards and the effectiveness of government affairs disclosure,in order to better improve the government affairs disclosure system.
