Research On The Legal Implementation Issues Of Social Responsibility Of Commercial Banks In China

At present,the risk of uncertain global economic development has increased,and China's domestic economy has entered a new normal stage.Commercial banks will also face new challenges in the process of providing financial services.Actively fulfilling the social responsibility to stakeholders will not only help to enhance the market competitiveness of commercial banks,but also help to play its financial regulation function and promote the overall interests of society.However,in the short term,the content of social responsibility of commercial banks is in conflict with their operating objectives of pursuing profits,which makes commercial banks less willing and motivated to perform social responsibility.In order to solve this problem,we can promote the commercial banks of the obligatory subjects to actively fulfill their social responsibilities to the stakeholders by giving full play to the function of institutional norms in the protection of the legal system.Therefore,taking the legal issues of corporate social responsibility of commercial banks in China as the research object,focusing on the analysis and solution of the shortcomings of the legal mechanism in China,and then improving the corresponding legal protection mechanism in China,is an important institutional guarantee for commercial banks to actively assume social responsibility in the norms of the legal mechanism.In studying the legal implementation issues of social responsibility of commercial banks in China,this paper mainly uses the basic theory of economic law and the theoretical tools of hard law and soft law which are ubiquitous in the economic legal system to analyze the current static legal system and the current situation and problems of law enforcement in China,and finally,puts forward suggestions on perfecting the legal system mechanism based on the problem-oriented approach.In addition to the conclusion,this paper is mainly divided into four parts: the first part is an overview of commercial banks' social responsibility,mainly analyzing the basic connotation,nature and theoretical basis of commercial banks' social responsibility;The second part elaborates the current situation of the legal implementation of commercial banks' social responsibility in China,mainly from three aspects: the basis of law implementation,the effectiveness of legal implementation and the problems existing in the implementation;The third part is to perfect the Legal Countermeasures of socialresponsibility of commercial banks in China.On the basis of learning from the law enforcement mechanism of foreign commercial banks,it mainly puts forward the ways to improve the legal system of our country from the aspects of perfecting the basic hard law legislation,refining the soft law enforcement mechanism,strengthening the law compliance and strengthening the accountability investigation.
