The report of the 19 th National Congress of the CPC stressed that the expression of public opinion should be fully guaranteed in the process of legislation in order to promote democratic legislation.With the further development of Internet technology,the public can get more current affairs news through Internet platform,and people are more inclined to use Internet platform to publish their legislative opinions and ideas,the Internet has gradually become an important channel for the expression of public opinion in the legislative process.Unlike the traditional ways of holding symposia,individual interviews,and so on in the past,the development of new technologies,especially the mobile Internet in recent years,has not only increased the convenience of the public in expressing legislative proposals,lower the threshold of public expression,maximize public participation,but also to further simplify the public selection process,reduce the cost of legislation.Therefore,in the Internet context,in order to ensure the quality of legislation,truly achieve democratic legislation,through the network platform for legislative expression of public opinion is an inevitable trend.However,China's current Internet technology conditions are limited,the composition and structure of netizens are more complex,and there are defects in the online public opinion expression mechanism in the legislative process,especially in the face of various kinds of hard-to-distinguish true and false information on the Internet platform,many netizens are unable to think independently and rationally,and may even fall into the awkward situation of being in agreement with others,making the authenticity and freedom of legislative public opinion unable to be guaranteed,all these have brought many challenges to the online public opinion expression in the legislative process.From the analysis of the current situation of the expression of public opinion on the Internet in the legislative process,the problems of the expression of public opinion in legislation can be summarized as the limitation of the main body of expression,the falsity of the content of expression and the irrationalityof the form of expression.Through the Internet,anyone and any organization can speak freely in the public space and express their attitudes and views on the legislation,although some of them are quite ridiculous,but in the virtual world of the web,too,there is tolerance.On the other hand,China's existing Internet legal system is still not complete,and there are also deficiencies in the legislative organs' work of collecting,integrating and communicating and responding to online public opinions,the above-mentioned reasons lead to the dilemma of online public opinion expression in the legislative process.This article is based on the Internet background,starting from the current situation of the expression of public opinion on the Internet in the legislative process of our country,summing up the problems,analyzing the reasons,starting from the three different levels of the netizens themselves,the legislature and the legal system,put forward some perfect countermeasures.
