Research On The Legal Regulation Of Price Fraud

The market decides the price is the key that the market plays a decisive role in the allocation of resources.Price guides the flow of market resources and is the baton of market operation.Price mechanism is also the core of market mechanism.The process of establishing and perfecting China's socialist market economy is also a process of constantly deepening the reform of the price system.In the process of price system reform,market competition is becoming more and more fierce.In order to survive in the fierce competition,operators take various ways to seek benefits and constantly expose the true nature of seeking profits.Among them,price fraud is one of the means they often take.At present,the legal regulation of price fraud in China originates from the theory of civil fraud.The price fraud is mainly adjusted by the price law of the People's Republic of China,the protection law of consumers' rights and interests,the anti-unfair competition law,and other relevant laws,regulations and normative documents.However,there are still many defects and problems in the regulation of price fraud in the current laws and regulations in China,such as unclear definition of relevant concepts,imperfect liability system,limited punishment and so on.Therefore,in view of this situation,the author analyzes the deficiencies in the price fraud legal regulation in China,and uses the experience and practices of other countries for reference,then puts forward countermeasures to improve the price fraud legal regulation in China.The article first introduces the background,significance,content and method of this research;secondly,analyzes the theory of price fraud,and analyzes the concept,constitution,cause and manifestation of price fraud;thirdly,summarizes and analyzes the current situation of price fraud regulation in China,and points out the problems existing in the legal regulation of price fraud in China by combining the deficiencies and defects in legislation,law enforcement and judicial practice;finally,aiming at the problem that price fraud in practice can not be effectively regulated,then based on some effective practices abroad put forward some thoughts and specific countermeasures to improve the legal regulation system of price fraud in China.
