On The Copyright Protection Of AI Generated Content

With the advent of the era of big data,artificial intelligence is becoming more and more mature in the field of deep learning.The application of artificial intelligence technology is also integrated into all aspects of our life,especially in the fields of literature,art and science,which constantly generate content comparable to human works,which has a huge impact on the copyright system.In theory,it is urgent to identify its nature and ownership of rights At present,the academic community basically agrees with the copyright of AI generated content,but there are still differences on the ownership of rights.There are many viewpoints,such as "artificial intelligence simulation theory","artificial intelligence designer theory","artificial intelligence user theory" and "artificial intelligence owner theory".First of all,this paper starts from the concept of AI generated content,defines the research object,deeply discusses the generation mechanism of AI generated content,and lays a certain technical foundation for the theoretical research of copyright law.Secondly,it compares the nature of the existing AI generated content and the theory of ownership of rights,and analyzes the advantages and disadvantages.It is found that it is necessary to identify the AI generated content as a work in terms of judicial practice,industrial development and equal interests of all parties.On this basis,it is more realistic and operable to give copyright to AI users.Finally,it is suggested to build a copyright protection system of AI generated content with users as the core in China.At the same time,the relevant regulations of work can be applied by analogy,so as to avoid the public security risks caused by untrue signatures and prevent the impact on the social evaluation system based on work formation.Considering the special nature of AI generated content,while providing it with sufficient protection to ensure its effective use,we should also reconstruct the tort liability system associated with AI generated content to achieve the integrity and effectiveness of copyright protection.
