With the rapid development of our country's economy,the employment patterns of enterprises are showing a varies trend,and the labor relationship are also increasing.China's laws give enterprises the right to formulate labor regulations and systems.Enterprises can formulate codes of conduct that regulate enterprises and laborers in accordance with their own production and operation characteristics and employment management methods.In practice,when enterprises formulate labor rules and regulations,they pay too much attention to safeguarding their own rights and interests and formulate illegal or unreasonable labor rules and regulations,which directly violates the legitimate rights of labors and may cause labor disputes in the future.Only reasonable and legal labor procedures with proper procedures can guarantee the legal rights of enterprises to use their own labor and avoid the risk of adverse consequences in labor disputes.At present,China's laws do not have clear provisions on the concept and nature of enterprise labor regulations,and there is no unified theory in this field.This has also caused the development of many rules and regulations for company.However,there are many risk views in the corporate regulations.This article focuses on researching the risks that enterprises have in the process of formulating and implementing rules and regulations,and puts forward corresponding prevention suggestions for these risks.The article aims to provide basic theoretical support for studying the legal risks of enterprise labor regulations through qualitative analysis,case analysis,and experience summarization.Based on the actual jurisprudence of the court,it summarizes the legal risks existing in enterprise regulations and integrates its own work.Experience,in-depth inspection of the actual business,in order to summarize the recommendations to prevent legal risks with practical operational guidelines.The suggestions put forward by the author are helpful for enterprises to standardize the employment system,maintain harmonious labor relations,and promote the orderly development of the social economy.
