Study On Administrative Interviews

With the reform and development of the rule-of-law country and the rule-of-law government,the concept of democracy and the rule of law is gradually deeply rooted in the hearts of the people.The development of balance theory and risk society theory has laid a solid theoretical foundation for the emergence of administrative interview.Because of its unique characteristics such as non-mandatory,flexible and loose by legal regulation,administrative interview has been favored and applied to more and more fields since its appearance.It plays an important role in building service-oriented government,reducing administrative disputes,improving administrative efficiency,saving administrative cost,making up for the lag of legal regulation,and protecting the rights and interests of administrative counterpart and the public interest.However,as a new administrative regulation tool,the development of administrative interview is not yet mature.Because of the weak theoretical basis and the absence of superior law,the alienation problems such as coercion and abuse in the practice of administrative interview need to be solved urgently.This paper is mainly divided into three parts to discuss the administrative interview system.The first part mainly summarizes the administrative interview system,traces the background and practical necessity of the rise of the administrative interview,clarifies the orientation of the administrative interview in the traditional administrative regulation pedigree and analyzes the main contents of the administrative interview system,in order to uncover the mystery of the administrative interview system.The second part takes the legal standard level and the practice level of the administrative interview as the foothold,and thinks about the problems that exist in the legal standard level and the practice operation of the administrative interview system in our country.In the third part,the author tries to put forward some suggestions on the rule of law from the aspects of determining the basic principles and perfecting the system.It is hoped that our country’s administrative interview system can enter the road of standardization and rule of law as soon as possible,and give full play to the unique value and function of the administrative interview system.
