Study On Perfection Of Administrative Interview System Of Food Safety In China

With the continuous development of market economy in our country,food safety is not only an important part of national strategic security,but also the focus of attention of the people.Food safety problems emerge in endlessly.Food safety supervision departments step up daily supervision and severe punishment.However,the development trend of building service-oriented government puts forward new requirements for the supervision level of administrative organs.As a new flexible management method of administrative organs,administrative interview originated in the field of taxation,and then gradually expanded to the fields of safety in production,environmental protection and so on.It is also favored by the food safety supervision department.In 2010,the State Food and Drug Administration issued < on the establishment of catering service food The notice of the interview system of the person responsible for safety was followed by the formulation of the normative documents of the administrative interview of food safety,and the administrative interview of food safety was written into the Food Safety Law in 2015.The administrative interview on food safety coincides with the theory of balance,the theory of public participation and the theory of flexibility,and plays a positive role in practice.However,due to the immaturity of the development of the system,there are still problems in legislation,procedures and supervision and relief.It needs to be further improved.By using the research methods of empirical analysis,literature analysis and comparative analysis,the author selects the relevant legal texts and makes a deep study on the administrative interview system of food safety.The first chapter defines the concept,nature and theoretical basis of the food safety administrative interview system,and the second chapter studies the main body and object of the interview,the scope and content of the interview,the interview procedure and the consequences on the basis of the analysis of the legal text.The third chapter selects many cases,expounds the present situation of the food safety administrative interview system,and confirms the function of the food safety administrative interview;the fourth chapteranalyzes the existing problems of the food safety administrative interview system,including the legislation.Preparation,negotiation becomes weaker,the procedure is not standard,the operation is closed,the lack of supervision and relief mechanism and so on;According to the problems existing in the administrative interview system of food safety,the fifth chapter provides some suggestions from five aspects: perfecting the legal system,defining the principles,standardizing the interview procedure,strengthening the disclosure of information,and constructing the supervision and relief mechanism.In order to improve the food safety administrative interview system to provide certain help.
