In the history of the United States,there have been thousands of lynching against black people.White mobs killed black people without any scruple and claimed that their purpose was to punish criminals in order to realize justice.However,a large number of lynching victims have been arbitrarily labeled as "rapist","murderer" and so on,and many people have been subjected to atrocities without any criminal charges.Mobs often show a disregard for the law.In fact,lynching is not a means of crime control,but a tool of racial control by white mobs against black people.In the second half of the 19th century,when African Americans turned to the U.S.Supreme Court,the U.S.Supreme Court gave up the protection of the victims of lynching on the grounds of the principle of "State action",which further spread the terrorist lynching and social injustice.By the 20th century,white mobs directly challenged the authority of the U.S.Supreme Court by breaking into prison to lynch federal prisoners.At this point,the U.S.Supreme Court finally realized the seriousness of the problem of lynching and the urgency of maintaining the rule of law,and began to change its attitude towards the problem of black lynching.After entering the 20th century,the U.S.Supreme Court starts to make big difference to the history of United States by convicting the sheriff and the members of the mob for contempt of the court,ruling that the trial led by the white mobs violates the due process of law,providing free lawyers to the poor defendants in the death penalty cases and making a guilty judgment on the lynch mobs,its attitude towards the lynching problem is discernible,which greatly curbs the occurrence of lynching.On the issue of black lynching,the reason why the U.S.Supreme Court has such a change is not only the function of internal factors such as judicial philosophy and judge composition,but also the influence of external factors such as the development of federalism,the change of social reality and public opinion.Although the attitude of the U.S.Supreme Court towards lynching in different periods is different,it reflects the mainstream public opinion at that time in general.On the whole,the U.S.Supreme Court has played a positive role in the fading of lynching of African Americans.
