The Discussion Of The Reform Of The Detention Center Management System

Since its birth,Chinese detention center has a history of more than 100 years of development.Its jurisdiction has undergone several changes,and its management system has been continuously improved.It has gradually formed a relatively stable management system under the jurisdiction of public security organs.As time goes by,the development of society the progress of human common civilization of rule by law,and the continuous improvement of the level of modern communication has brought the detention center from the behind-the-scenes under the criminal procedure to the public gradually.Some of its long-standing problems have also slowly appeared.The sensational" Duomaomao" incident in 2009 has aroused strong concern from all walks of life on the issues of prison bully,extortion of confession by torture,extended detention,and even detainees’ unusual death and other issues concerning human rights and legal guarantees,which once again put the issue of the long-held detention center management system on the table.The mainstream view is that public security organs that are simultaneously responsible for investigating and solving unresolved functions will inevitably abuse the pending custody rights because of the need to investigate and solve the case,thereby damaging the human rights of criminal suspects and defendants,and even violating the judicial justice in the process of investigation and solving cases.Though he public security organs have made considerable progress in the standardized management of the detention center in recent years,the aforementioned problems have not been solved fundamentally.Therefore,the reform of the management system of the detention center is imperative.This paper starts with the birth,development and formation of Chinese detention center,and analyzes the reasons for the formation of the modern detention center management system in China.At the same time,through the comparison with the management system of the pending prison places and the management system of prisons in China,this paper analyzes the advantages and disadvantages of the modern detention center management system in terms of jurisprudence,human rights protection,and scientific setting of functions.The author will combine the work experience,practical cases and internal data of the detention center to analyze the current mainstream views on the reform of the management system of the detention center,and demonstrate the feasibility of assigning the detention center to the jurisdiction of the judicial administrative organ.
