Research On Problems Of WTO Rules And The Application Of The Laws In The Context Of Sino-us Trade War

In 2018,the United States continued to take extreme trade measures against China,resulting in escalating trade friction between China and the United States and setting off a new round of trade disputes.Although China and the United States have sued each other to the WTO dispute settlement mechanism,up to now,this trade friction issue has not been resolved,and the two countries are still in the process of solving and negotiating with each other.The trade war between China and the United States involves the legitimacy of investigations 201,301 and 232 under the marrakesh agreement on the establishment of the world trade organization(WTO).In the process of analyzing its legitimacy,problems of WTO rules and the application of laws have been exposed,which have become more obvious with the deepening of trade wars.Therefore,it is necessary to perfect WTO rules and the application of laws to solve the problem of trade relations between WTO members and maintain the authority of WTO.With this as the objective,this paper first introduces the theoretical issues of international law involved in the sino-us trade war,mainly elaborates the theories of international treaty interpretation,unilateralism and multilateralism,and the relationship between domestic law and international law.Secondly,the measures taken by the United States in the trade war are analyzed in detail.Finally,,the author puts forward some suggestions by analyzing the problems of WTO rules and the application of laws in this trade war.The purpose of this paper is not only to analyze the problems of WTO rules and the application of laws exposed by the sino-us trade war,but also to analyze the original problems of WTO rules and the application of laws exposed by the sino-us trade war and how to improve them.The goal of this paper is not to analyze how to solve this trade war,but to promote the improvement of WTO rules and the application of laws.Through the above analysis,this paper aims to provide suggestions for China's dispute settlement in the multilateral framework of WTO and how the WTO dispute settlement mechanism can play a better role in the future trade disputes among its members.
