A Study On The Legal Psychology Of Local Officials In Religious Cases Of Shandong Province In Late Qing Dynasty

In the late Qing Dynasty after the middle of the 19 th century,missionaries followed the invasion of Western powers to China,and they had a feverish religious belief in the hope of spreading Christianity and naturalizing the decadent Qing Dynasty.The behavior of these missionaries broke the traditional Chinese social order and ethical concept,and caused the teaching plan of educational administration to continue.The missionary represents the capitalist cultural system,and our country has always pursued the cultural value system of the feudal society with Confucianism as the core.In the traditional feudal society,the official and the Chinese cultural value system are more closely blended than any other class,they have received the education of Confucian tradition and value since childhood,their social status and prestige are largely based on the action of active use of this tradition and value,so officials must be the most direct embodiment of this conflict.At the same time,officials are direct arbiters of the civil-religious conflict.From the perspective of law,this paper analyzes the local bureaucrat's legal mentality and its changes in different periods,focusing on the coping strategies of Shandong local bureaucrats in the face of religious cases.The first part is to explore the legal psychology.Because the legal psychology is a relatively novel proposition,it has not yet been clearly defined.The author tries to describe the concept,characteristics and influencing factors of legal psychology from the angle of combining law and psychology to make it serve the theme of this paper.The second part is the introduction of Shandong religious cases.The paper mainly introduces the spread of Christianity in Shandong Province,the reasons for the frequent occurrence of religious cases in Shandong Province,the organization and procedure of religious cases in Shandong Province.This part is equivalent to the background introduction,the purpose is to make everyone have a systematic understanding of the religion cases that occurs in Shandong area.The third part divides the religions cases of the late Qing Dynasty into three different periods: relaxation period,release period,norm preaching period,combing the development status of the religions cases of Shandong in three different periods,the legal basis of the religionscases treatment,and through the concrete religions cases objective description negotiation process and the final processing result,analyzes the local official in the religions cases processing process concrete and the slight behavior manifests the different legal psychology.The fourth chapter focuses on the reasons for the change of the local officials' legal psychology and analyzes the difficult situation of the local officials in the course of handling the religious cases.
