Research On Legal Personality Of Artificial Intelligence

The emergence and development of artificial intelligence has changed the human life style to a great extent,made the life more colourful,it makes the relationship of them more and more close,at the same time,it also produces many problems as well as worrying about the legal system in the future.To deal with the legal challenges,it is needed to put artificial intelligence in the context of law,this needs to discuss a series of questions such as the legal status of artificial intelligence,whether it has legal personality and what kind of legal personality it has.Therefore,in the introduction,this paper briefly expounds that artificial intelligence has been applied more and more widely and frequently in various fields,from VR technology to intelligent wearable devices,self-driving cars,to face recognition technology,intelligent robots,etc.,after artificial intelligence has had an indelible impact on every aspect of human life,it is difficult to divide the tort liability through artificial intelligence,and driver-less cars cause people harm,and other legal difficulties,it is pointed out that there are legislative and institutional gaps in the legal personality and legal liability of artificial intelligence in China,so it is necessary to construct and perfect the legal personality system of artificial intelligence.The paper concludes four parts.The first part is the meaning of the legal personality,the elements of artificial intelligence,the characteristics of the legal personality described.The second part is the theoretical and practical basis of the necessity of legal personality of artificial intelligence,which elaborates human beings from the perspective's of theory and practice.Theoretically speaking,there are three main viewpoints of scholars,including "electronic personality theory","electronic agent theory" and "fiction theory".The author agrees with the theory of pseudo-personality and further constructs it on the basis of the characteristics of artificial intelligence technology.In social practice,the development of artificial intelligence technology and the effective rule of artificial intelligence make it serve human beings better and so on.The third part is the legal and technical support of the feasibility of artificial intelligence legal personality.In order to judge whether artificial intelligence can obtain the legal personality,we need to consider the level of artificial intelligence technology development and whether the current legal system can accommodate the personality.The fourth part is the artificial intelligence legal personality system construction,including the artificial intelligence legal status and the degree of the legal personality to be clear through the legislative means,the right ability and the responsibility construction.
