Research On The Present Application Of The Parole System

Parole is an executive penalty system in which the punishment is mitigated and socialized. On one hand, it compensates for life imprisonment and long-term freedom penalty (either unlimited deprivation of suspects' liberty or excessive indulgence); on the other hand, it plays an important role in prisoners' smooth returning and adapting to the society. It is always the favor of criminal legislation and judicial practice all over the world. Due to the particularity of the imprisoning places, we know very little about how prison staff apply the parole system, how the condition for parole is quantified objectively, and what role the procuratorate plays in it. In the paper, a survey is made on the parole of Heze Prison in Heze city and Yunhe Prison in Jining city in 2008,2009 and 2010. Then the firsthand material collected from the survey is analyzed and discussed in detail. The profound analysis and discussion on the parole applications filed, the circulation of files, the role of procurators in the parole process and so on, is supposed to be of theoretical and practical significance for the future work of the prisons procuratorial department.
