Study On Chinese Measures To Deal With New Trade Protectionism

At present the world economy shows signs of slowing down,new trade protectionism has different characteristics from the past.China is a big trading country,and export trade is very important to our economy.With the continuous aggravation of new trade protectionism in the world,the international trade environment that China is facing is more complex,and the export situation is not optimistic.Therefore,it is very important to study how to deal with the new trade protectionism,promote the development of Chinese foreign trade and reduce the impact of the new trade protectionism on China.This paper is divided into the following five parts:The first part is the introduction,which introduces the research significance and background of this paper,research document summarize of internal and external,ideas and methods of research,objectives and innovations of research.The second part compares the difference between trade protectionism and trade protection,the difference between trade protectionism and trade restriction,and the difference and connection between new trade protectionism and traditional trade protectionism,so as to define the basic meaning of trade protectionism and new trade protectionism.The new characteristics of the new trade protectionism are analyzed and summarized.This paper summarizes the five stages of the historical development of trade protectionism,analyzes the laws and finds out the reasons for the rise of new trade protectionism.The third part lists the concrete forms of the new trade protectionism in the law,including the abuse of trade remedy measures,the new trade barrier and the government intervention of trade protectionism.Analyze the impact of these concrete forms.The fourth part summarizes the measures taken by the international community to deal with new trade protectionism from within and outside the framework of WTO.Within the framework of WTO,the restrictions and shortcomings of the new trade protectionism in the "Agreement on Technical Barrieries to Trade ","Government Procurement Agreement",and "Understanding on Rules and Procedures Governing the Settlement of Dispute" were analyzed.Outside the framework of WTO,this paper analyzes the domestic legislation oftrade protectionism in the United States,the European Union,Japan and India respectively.The fifth part is based on Chinese actual situation and draws on the countermeasures of the international community.Formulate Chinese measures to deal with new trade protectionism.Within the framework of WTO,actively use WTO rules and put forward suggestions for improvement,improve the coordination of domestic legislation and WTO rules,and rationally use trade remedies.Outside the framework of WTO,the macro response to new trade protectionism should improve the "Foreign Trade Law",optimize Chinese trade early warning mechanism,and strengthen the construction of the "the Belt and Road Initiative" and regional organizations in free trade areas.In response to the abuse of trade remedies,China should regulate the export order and actively respond to complaints,and improve the domestic legislation of Anti-dumping,countervailing,safeguard and special safeguard.To deal with the new trade barriers,it is necessary to improve Chinese legal system for trade barrier investigation and labor protection system,and improve the legal system of technical regulations,technical standards and conformity assessment procedures.Enterprises themselves should improve their independent innovation capabilities.In response to the national security review of foreign investment,Chinese companies should resolutely oppose the review beyond national security and actively take remedies.On the other hand,companies should be more cautious about making overseas investments.
