Research On The Right To Participate Of Disabled Athletes

The development of both able-bodied sports and disabled sports cannot be separated from the social support.Compared with able-bodied sports,disabled sports emerged in the western world war I period,which was far behind able-bodied sports.The development process of disabled sports is slow.Both the physical limitations of disabled athletes and the support of the whole society make the development of disabled sports slow.In the field of physical education for the disabled,there are few studies in the field of law.In terms of the protection of the rights of disabled athletes,the relevant research even less.With the development of society,the voice of human rights protection is increasingly strong.As a vulnerable group in the society,the protection of the human rights of the disabled should be paid attention to.As a special group,the disabled athletes should enjoy the rights according to the law and need to be protected without discrimination.In practice,however,the rights of disabled athletes are not protected.As a sport,the realization of the right to participate is very important for athletes.With the development of disability sports,there is a demand for disabled athletes to compete with able-bodied athletes.In this paper,sports as a part of people's daily social life has become increasingly important;and from the perspective of promoting the development of sports,sports for the disabled,as a part of sports,should be valued and developed at the same time.In the system of athletes' sports rights,whether the participating rights can be realized or not determines whether other sports rights can be realized.The right to participate is in the basic position in the sports right system.The core of this paper is the right of participation of disabled athletes,that is,whether disabled athletes have the right to participate in all sports.Because of the existing separate rules in the field of sports,sports for the disabled and sports for the healthy are held separately.This system has its rationality.With the continuous development of sports,when there is a call for disabled athletes to apply for the perfect people's games,we should pay attention to and support the demands of this special group.This paper will discuss the rights of disabled athletes from four parts.The first part of the article is about the theory of disabled athletes,from the definition of disability,the development of disabled sports,the legal basis of disabled athletes'right to participate,the status of disabled athletes' right to participate and the analysis of the reasons,leading to the key words of the article.On the basis of previous scholars' research,the second part of the article analyzes the legal term of athletes'right to participate and discusses the legal attribute of the right to participate.Through the comparison between the right to participate and the corresponding sports rights,the article explains the right category of the right to participate in a relatively complete way,and explains the importance of the right to participate in a certain length.The third part of the article further discusses the different factors that affect the athletes' access to the right to participate.The article systematically expounds from three aspects:sports equipment,sports risk and athletes' qualification system,and explains the three limiting factors by quoting corresponding cases.In the last part of the article,the author puts forward the viewpoint of how to protect the rights of disabled athletes.This paper thinks that we can put forward solutions from three aspects:the use standard of sports equipment,the health standard of athletes and the improvement of the qualification system.
