Study On Legal System Of Disabled Athletes In Competive Sports

The success of 2008 Beijing Olympic Games and the two Olympic Games brilliant achievements show that, the athletics sports of our country has entered a new stage of development. With the deepening of the occupation and the market-oriented of competitive sports, high risk and high combat sports will expose wounded and disabled athlete problems to a more severe position. In contrast, athletes’social security system construction work, obviously lagged behind the development of competitive sports, is becoming the main obstacle on our country’road to the "sports power".In this paper, through the collection, collation, analysis of the literature, namely the literature research method, disability protection present situation and the existing problems during the development of our competitive sports is in the detailed analysis. Then a comparative study focuses on foreign athletes disabled security system. Finally, from the necessity and the feasibility of the point of view, the specific proposals aim at constructing the law system of our country wounded and disabled athletes.The article totally is divided into four parts. The first part is the introduction, focuses on the description and analysis of this study’ purpose and significance. The last three parts are the main structure of this article, mainly introduce the current situation of disability in competitive sports, view the existing problems, and give the corresponding solutions, and ultimately to establish the legal system of our country disability support services.The first part is the first chapter, mainly introduces the background and significance of the topic, bases on the existing research results at home and abroad to summarize the general character and the insufficiency, and explains the original intention of this paper.The second part is the second chapter, focuses on the disability status and defects of China’s competitive sports, sums up the risk of disability and the serious consequences of sports from the examples of wounded and disabled athletes, points out sports career challenges that they have faced with, then analyses the existing system to deal with the deficiencies of measures for wounded and disabled athlete through comprehensive review of different stages of the disabled athlete safeguard measures since the founding of new China.The third part is the third chapter. According to the global and universal problem of disability athlete, and rich experience of sports development in the four country, America, Japan, South Korea and Australia, this part considers them as a reference object, introduces the legal system of social security of athletes, athletes sports insurance system and management mechanism. Through the understanding of the development of foreign athletes security system, our country can learn the good sides.The fourth part is the fourth chapter to provide solutions for making up for the defects of our system. With foreign athletes disability protection system and experience for reference, and combining with China’s national conditions, specific proposals are put forward to perfect the legal system of competitive sports in China, including speeding up the legalization process for disabled athletes security system, developing sports insurance system, and building scientific and reasonable management mechanism for wounded and disabled athletes.
