The Restriction Of Administrative Law On Government Procurement Of Public Services

Government procurement of public services are a major change in the way of providing public services,it plays an important role in expanding the coverage of the public service system,improving service quality and meeting the masses' demand for public services.Government procurement of public services are still in the stage of active exploration now,there are still some problems from practice to legal application.On one hand,the government has some improper behaviors,such as default unilaterally and buy internally.Moreover,the public is also dissatisfied with the services procured by the government.On the other,it may be hard for the law to regulate the government's conduct effectively.The law lacks an effective scope of purchase of services.There exist some imperfect points in our law,such as the loss of contract system,the formalization of budget control system,and the imperfection of performance evaluation mechanism.These problems affect the reform of government purchasing public services,which made it difficult to play its due role.Accordingly,it is essential to perfect legal framework of government procurement of public services both in substantive law and procedure law.In substantive law,here are a few suggestions:strengthening the legal binding effect of the law on government procurement,defining the boundaries of government purchases,improving the contract management system for purchasing public services,strengthening management and supervision of public finance.In procedure law:firstly,it must establish and improve public participation system.Then,it should establish the information publicity system overall process.Finally,it also need to set up standard procedure to ensure the smooth development of government procurement of public services..
