Research On The Knotty Problems Of Agricultural Insurance Contract Disputes

Agricultural insurance contract dispute is a new type of civil dispute in the field of agricultural production.Due to the imperfection of the legal system and the novelty of the case,there are various difficult problems in this kind of dispute.In order to study the problems related to agricultural insurance contract disputes,this paper selects a typical case of xiong,shengmao company v.picc company to discuss.The disputes arising from this case mainly include: first,whether the interpretation clause of freezing disaster stipulated in the contract is valid;Second,can you refer to the minutes of meeting made by guangxi insurance supervision bureau? Third,whether this case belongs to insurance liability scope,if belong to insurance liability scope,how much is the amount of compensation.Through legal analysis of the difficult issues of case disputes,this led to the author's expanded thinking on the resolution of difficult issues of agricultural insurance contract disputes,including the optimization of agricultural insurance contract dispute resolution mechanisms and the improvement of agricultural insurance contract systems.Regarding the optimization of the dispute resolution mechanism for agricultural insurance contracts,suggestions were made to improve the dispute resolution approach,that is,to explore the establishment of an agricultural insurance arbitration committee system,to improve the burden of proof system,including the insurer 's previous work regulations,and to improve the agricultural insurance loss judicial identification system.Regarding the improvement of the agricultural insurance contract system,suggestions were put forward to improve the functional positioning of the government to guide the development of agricultural insurance,improve the setting of contract interpretation clauses,and improve the legal consequences of invalidation of agricultural insurance contracts,that is,to distinguish between the occurrence of insurance accidents and the absence of insurance accidents.
