Legislative Cooperation In Guangdong-Hong Kong-Macao Greater Bay Area

The cooperation and development of the Guangdong-Hong Kong-Macao Greater Bay Area is of great practical significance for implementing the principle of one country and two systems,deepening China's reforming and opening process,promoting Belt and Road economic construction.At the same time,the Greater Bay Area is also of great theoretical significance for exploring the regional integration of rule of law and the practice of regional rule of law with multiple subjects and patterns.Therefore,this study focuses on the cooperation and development of the Greater Bay Area.After reviewing the relevant literature on the cooperation and development of the Greater Bay Area,it was found that many studies have proposed to strengthen the legal and institutional construction of the Greater Bay Area through legislation,however and in fact,there is less research on this topic,which is difficult to provide more theoretical guidance for the the cooperation and development of the Greater Bay Area.Therefore,the purpose of this study is to carry out relevant research from the perspective of legislation,and specifically explore the core issue of "how to promote the cooperation and development of the Greater Bay Area by legislation"Understanding the status of the legislation in the Greater Bay Area is the first step in answering this question.Based on this,through a series of combing of legal texts and relevant empirical analysis,this study found that legislative differences including legislative authority,legislative quality and legal conflicts exist in the Greater Bay Area.The legislative differences have two sides.It may both exacerbate obstacles to cooperation and development of the Greater Bay Area and create opportunities and conditions for cooperation and development in the Greater Bay Area.Therefore,careful treatment of legislative differences is the key to promoting cooperation and development in the Greater Bay Area.However,the current form of administrative cooperation is difficult to cope with legislative differences,and it is even more difficult to promote the implementation of the cooperation and development of the Greater Bay Area.Therefore,other forms out of administrative cooperation need to be conceived to change the existing dilemma.Considering that legislation is the logical starting point for the practice of the rule of law,coordinating legislative differences between the 11 cities in the Greater Bay Area through legislation can solve the problems from the origin Based on this,the research proposes that legislative cooperation is an effective way to promote the cooperation and development of the Greater Bay Area while taking advantage of legislative differences and avoiding the negative effects of legislative differences when administrative cooperation is gradually becoming weakIn order to demonstrate the applicability of legislative collaboration in the Greater Bay Area,a comparative analysis of the relevant theories of legislative cooperation reveals the legislative cooperation in the Grater Bay Area is appropriate to obtain legitimacy through a form of authorization by the NPC or its standing committee.It is advisable to adopt a decentralized legislation model,and the Greater Bay Area should establish corresponding legislative cooperation agencies and supporting mechanisms to ensure the implementation of the legislation cooperation work in the Greater Bay Area in an all-round way,thereby escorting the cooperation and development of the Greater Bay Area.
