Research On The Legal Aid Problems For The Migrant Workers From The Perspective Of Social Governance

Since the reform and opening-up,the ability of China’s urbanization transformation has been advancing at a high speed,and a large number of migrant workers have been pouring into cities to work.While they have made great contributions to the social economy,it is not uncommon for their legitimate rights and interests to be harmed,the problem is acute.All along,government departments have actively explored effective ways to protect the rights and interests of migrant workers and taken various measures to deal with the situation.Preliminary results have been achieved in the work of safeguarding the rights and interests of migrant workers.However,due to the heavy tasks and the difficulty of the work,the problem has not been effectively solved,affecting the harmonious development of society.Taking the legal aid of migrant workers in the P district of Guangzhou City as an example,this paper analyzes the causes from the perspective of Social Governance,and explores new and effective social governance countermeasures,highlight the role of legal aid for migrant workers in social governance in the context of rule of law.Firstly,this paper defines the legal aid,rights and interests of migrant workers by literature research method,and takes the theory of social governance,social equity and justice,synergetic governance as the theoretical basis then through the questionnaire analysis of the P district migrant workers and legal workers involved in the process of legal aid problems.Based on the analysis of the questionnaire and the results of field observation on the legal aid situation of migrant workers in district p,there are three deficiencies: As far as the migrant workers themselves are concerned,their basic rights and interests can not be guaranteed,and their awareness of safeguarding their rights is weak;as far as the work of safeguarding their rights is concerned,as far as legal workers are concerned,the base number of aid cases is heavy,and the degree of implementation of cooperation among all parties is low.The main reason for these problems is that legal aid for migrant workers has not been given enough attention and support is not strong enough,and the relevant laws and regulations on legal aid have not been implemented while violations of labor laws by migrant workers are still prominent,the implementation of the award is a serious problem,publicity and assistance work is not grounded enough,the lack of reasonable management methods,and so on.In view of the above-mentioned practical difficulties,this paper proposes to continuously improve its own system construction,optimize the operating mechanism of institutions,expand and standardize public services,and solve the problem of difficult implementation with the support of the state and the publicwelfare,with the help of new media,the author tries to find a new way to develop legal aid for migrant workers in P district.
