Research On The Dilemma And Countermeasures Of NPS Regulation And Control In China

The problems of novel psychoactive substances(NPS)has become a stiff challenge for anti-drug work in recent years.NPS,substances with similar functions and effects to illegal drugs but not yet under legal control,have as strong or even stronger narcotic,stimulatory,hallucinatory and inhibitory effects than drugs and are highly addictive.Being variable,concealable,and therefore badly harmful and yet not subject to the law,they have posed a great threat to social public security and health order.Fortunately,the international community has conducted a series of explorations and trials to cope with the problem of NPS.And the UN and some European and American countries have strengthened their control against NPS by amending regulations and establishing early warning mechanism and have already accumulated some experience.China also started its regulation and control of NPS almost synchronously.“Regulatory Approaches to the Control of Non-medical Narcotic Drugs and Psychotropic Substances” was released in 2015 and is now considered a legal document specially drawn up for control of NPS,but it has its limitations and lags behind due to its low level of legislation,indistinct provisions,and lack of supporting measures.Besides,the variations in regulatory documents from country to country and competing interest which is hard to balance between countries have also restrained international cooperation in this field.In the meanwhile,prevention publicity and education,investigation and crackdown,social correction,monitoring warning and other relevant measures taken to control against NPS can't adapt to the “novelty” of NPS,thus making it extremely difficult to carry out effective regulation and control measures.The author thinks that purposeful precise strategies should be implemented to solve the existing prominent problems in the regulation and control with NPS' integrated characteristics,causes of its abuse,as well as the current control situation at home and abroad all taken into account.First,perfect legislative regulation to make sure that there are rules and laws to follow when it comes to controlling NPS;Second,under the background of NPS' worldwide spread,it is necessary to promote and strengthen international cooperation to form joint defense and administration;Third,establish comprehensive monitoring management mechanism to discover and govern crimes concerning abuse of NPS in good time;Fourth,improve work on publicity and education about NPS to enhance people's cognitive and preventive skills.
