Research On The Anti-Monopoly Review Of Concentration Of Undertakings In Data-Driven Enterprise

China began to organize the legislative work of the anti-monopoly law in 1994.After more than ten years of exploration and research,the anti-monopoly law was finally promulgated and implemented in 2008.But now it is more than ten years ago,the development of social market economy is changing with each passing day.In the era of Internet big data,the business model of enterprises has ushered in great changes.Big data is favored by operators for its large quantity,large scale and fast speed,it can be updated in real time and has huge practical value,thus becoming an important resource for competition between market operators.In the process of development,data-driven enterprises will choose to centralize operators,and the trend is more and more frequent.Compared with traditional enterprises,data-driven enterprises have the characteristics of network externality,platform market and lock-in effect.Since Google acquired double click,a series of data-driven enterprise concentration cases,such as Facebook's acquisition of Instagram and Whats App,Didi's acquisition of Uber,have attracted more and more attention in the society.Scholars,industry,relevant departments and other relevant parties have begun to show high attention to this issue.Anti-monopoly law enforcement agencies are faced with more complicated problems than traditional enterprises in the review process of these centralized cases.And the existing legal system inevitably has its own lag and limitations.Based on the analysis of data-driven enterprise,a new model of enterprise concentration,this paper expounds the necessity of anti-monopoly review on this behavior,then finds out the problem of anti-monopoly review after data-driven enterprise concentration through the development of anti-monopoly review system and the existing legal regulation in China.Combined with the relevant experience and system designed in foreign countries,using the relevant knowledge theory,attempts to explore the perfect countermeasures that can be applied to the current situation of China's development,and can integrate with China's concentration review system,and effectively solve the problem of anti-monopoly review in the concentration of data-driven enterprises.Combined with the newly revised draft of the anti monopoly law,the author hopes to analyze from the perspectives of value concept,relevant standards,review contents and illegal costs,and put forward corresponding feasible suggestions,so as to better improve the solution of problems,better protect the interests of consumers,promote the fair competition of operators,and maintain the market economy through the improvement of the system and the support of technology To promote the healthy development of economy in the new era.
