Research On The Constitutional Protection Of Citizens' Environmental Rights Under The Perspective Of Beautiful China

For the first time,the report of the 18 th National Congress of the Party discusses ecological civilization in a single article,and calls for greater environmental protection,strengthening the protection of natural ecosystems and the construction of ecological civilization systems.For the first time in this report,"Beautiful China" is clearly regarded as the goal of China's environmental construction in the future,and the construction of ecological civilization is discussed from the height of the overall layout of the country.The report shows our party's deep understanding of the construction of socialist ecological civilization with Chinese characteristics.Paying attention to ecological environmental protection is not only beneficial to the present generation,but also responsible to future generations.With the importance attached to ecological civilization,and with the rapid development of the world economy,environmental degradation has become increasingly serious,and incidents that endanger the environmental rights and interests of citizens have occurred from time to time,and some infringement acts that indirectly endanger citizens' environmental rights have sometimes even failed to be litigated.There is no legal way to protect yourself.At present,scholars at home and abroad have mainly discussed and studied the citizen's environmental rights from the perspective of the meaning,nature,and content of environmental rights,but there is still no systematic study on why citizens' environmental rights need constitutional protection and what methods are used to protect them.It is precisely because these studies are very important to protect the environmental rights of our citizens.Therefore,how to protect the environmental rights of citizens under the background of beautiful China has become an urgent topic to be studied.At present,China's research on the protection of citizens 'environmental rights and the establishment of their legal status is still in its initial stage,and more scholars are needed to conduct research and discussion.This article discusses the protection of citizen's environmental rights from the definition,nature,the need of constitutional protection of citizen's environmental rights,and the countermeasures such as adopting citizen's environmental rights constitutional litigation system,combining the constitution with the sectoral law,and improving environmental protection consciousness.It provides some theoretical basis for the protection of citizens 'environmental rights in China and promotes the in-depth study of the constitutional protection theory.Establishing the legal status of citizen's environmental rights from the Constitution can provide the basis for the relevant legislation of citizen's environmental rights,standardize the corresponding safeguard measures,and make it have important practical significance.
