Research On Law Enforcement Organization Of Community Corrections In China

As an imported product,the community correction system has taken root and sprouted in our country.After 17 years of exploration and growth,it has gradually developed into a community correction system with Chinese characteristics.During the 17 years of practical exploration,due to the different actual conditions in various regions,community corrections law enforcement organizations showed different characteristics.As a criminal enforcement system,community corrections is indispensable for the unity and standardization of law enforcement.As the main body of national criminal enforcement,community corrections institutions and teams should be unified and regulated by the nature of criminal enforcement.This article uses community corrections institutions and teams as the research objects.On the premise of fully demonstrating the nature of community corrections and its institutions,this article explains the characteristics of community corrections institutions and teams.The author believes that community corrections is a criminal enforcement system.Community corrections institutions are institutions of criminal enforcement nature.They should have the characteristics of uniformity and independence,and their law enforcement teams should have the characteristics of specialization and professionalism;on the basis of a detailed introduction to the status quo of community corrections law enforcement organizations in China,summarize the characteristics and advantages of various law enforcement organizations,and pointed out that the current community correction law enforcement organizations in China has problems such as irregularity,inconsistency,and unprofessionalism.The author points out that because the community corrections system implementation in China is not long and has been in the reform trial stage,coupled with the lack of mature system design,resulting in the current community corrections institutions in China with inconsistent institutional settings,unclear institutional positioning,poor institutional independence and other outstanding problems.Community corrections law enforcement teams have problems such as poor team stability,unclear identity of law enforcement personnel,uneven specialization and low professionalism.There are many reasons for these problems.The main reason is that the nature of community corrections has not been clarified.There is no unified industry standard at the national level.There is no complete law to regulate for a long time,which makes the community corrections in various regions of our country has long been in a state of free development,resulting in a situation of inconsistent institutional settings and inconsistent personnel status.The existence of these problems will become the main factor hindering the long-term development of community corrections in our country.The author compares and analyzes the differences between the existing community corrections law enforcement organizations in our country,and combines our country's reality to propose a concept of community corrections law enforcement organization model construction.The author advocates that the law enforcement power of community corrections should be upgraded to the county level,the daily law enforcement work of community corrections should be separated from judicial offices,and independent community corrections institutions should be set up at the county level to exercise community corrections law enforcement powers.County-level community corrections institutions should have independent legal persons status,able to independently assume responsibilities to the outside;clarify the status and functions of the judicial office in community corrections,and the judicial office is entrusted or assisted by community corrections institutions to carry out community corrections related work;relying on county-level community corrections institutions to establish professional access standards,establish a community corrections team with relevant professional knowledge background and civil servant status to undertake the law enforcement work of community corrections in order to improve the law enforcement level of community corrections and make the community corrections law enforcement team of our country embark on a professional and specialized road.This idea is feasible and conforms to the provisions of the "Community Corrections Law".It should be promoted nationwide to promote the development of community corrections in my country in the direction of professionalization,specialization and standardization.
