Research On The Law Enforcement Problems Of Judicial Administrative Organs In Community Correction In China And Solutions

Community correction refers to the use of a non-custodial method to correct prisoners in an open community environment,and to correct and educate prisoners by integrating community resources,to help inmates change and adapt quickly to society.Since the development of community correction work in China,the executive branch has assumed the responsibility of community correction work,which plays a vital role in the smooth progress of community correction work and gradually mature norms.Therefore,the scientific determination and optimization of China's executive branch on the work of community correction,lay a solid foundation for the development of China's community correction is of great significance.However,in the specific judicial practice,there are still many problems to be solved in the implementation of community correction by the executive branch.First of all,the status of the executive branch as the main body of law enforcement is not clear and specific enough,laws and regulations on the law enforcement power are not clearly defined,so that law enforcement activities are not mandatory;Second,the Judicial Executive branch is relatively inadequate in the exercise of law enforcement means,law enforcement level is low;Third,the law enforcement procedures are not secure,the relevant departments do not link up properly,and the law enforcement funds are not allocated properly.Finally,public awareness is not high,social participation is insufficient,and the executive branch's law enforcement power lacks supervision and protection.In view of the above issues,the article,based on the current research situation at home and abroad,through consulting relevant data and references,takes the law enforcement of the executive branch in community correction work as the research object,based on practice,this paper analyzes and probes into the problems from three aspects: putting forward the problems,analyzing the problems and solving the paths.At the content level,this paper is divided into four parts: the first part,the background,domestic and international research situation,research significance of the executive branch in the community correction law enforcement are briefly introduced,to analyze the significance of community correction in the executive branch.In the second part,the author analyzes the general situation of the law enforcement power of our country's judicial executive branch,and studies the contents,methods and powers of the law enforcement of our country's judicial executive branch in community correction.The third part,using the positive analysis method,summarizes theproblems and difficulties of the community correction law enforcement work of the executive branch in China.The fourth part,using the value analysis method,in view of the judicial executive branch law enforcement process exists the insufficiency,unifies our country community correction execution pursue the value,from different levels to improve the implementation of China's executive branch community correction system recommendations.Through the paper,I put forward some immature suggestions to the executive branch in the community correction,and hope that more people will have a better understanding of the community correction work,to enable the executive branch to obtain more help and encouragement in the process of community correction,with a view to establishing a more complete community correction system in our country.
