A Study On The Legal System Of Government Regulation In India PPP Model

PPP mode of government supervision,as a factor running through the whole life cycle of PPP projects,is the guarantee of public goods and public service supply,and is also the key to avoid project risks.The PPP mode of Chinal,supported by the central policy,has experienced three years of savage growth,but also exposed a series of problems.India is the earliest country in the development of the PPP model in South Asia,drawing on the advanced experience of the birthplace of Britain,accumulating a large number of experience in project development,and establishing a relatively perfect legal system framework for government regulation of the PPP model.China and India have some similarities in their geographical,demographic and economic and social development situations.There are many similarities in the development of infrastructure needs,PPP models and the challenges they face,as well as in the thinking of solving problems.It is of great significance to draw lessons from India's experience to get rid of the development dilemma facing our PPP at this stage.The legal system of government supervision of Indian PPP model is the product of the combination of the relevant basic theory of PPP and the development practice of Indian PPP.Starting from the theory of public interest,the theory of entrustment responsibility and the theory of incentive regulation,this paper discusses the theoretical basis of the legal system of government supervision in the PPP mode,and summarizes the formation of the government supervision legal system of the PPP mode in India in the light of the explosion of infrastructure construction projects in India,the regulatory needs in the context of a series of financing policies,the promotion of international organizations such as the World Bank and the Asian Development Bank,and the legislative practice of the central government and various states of India.Secondly,this paper PPP the establishment and function of the government supervision agency of the infrastructure construction project under the PPP mode,and analyzes the whole life cycle supervision of the PPP mode government supervision legal system according to the operation process of the PPP project.Besides,it also discusses the complement and perfection of external forces such as the supervision of Indian legislature,the supervision of audit institution and the public participation,and discusses the function of constructing a systematic and complete PPP mode of government supervision legal system.Thirdly,through the discussion of the main contents of the government supervision of the Indian PPPmodel,the main features of the government supervision legal system of the Indian PPP model are refined and summarized,and the deficiencies of the government supervision legal system of the Indian model are evaluated.Lastly,the paper analyzes the enlightenment of the government-supervised legal system of Indian PPP model to the construction of PPP legal system in order to benefit the development of theory and practice.
