Research On Legal Issues Of Personal Information Protection In The Era Of Artificial Intelligence

The new technology represented by artificial intelligence enriches our life,but also accelerates the collection,utilization and dissemination of personal information,which brings us great challenges to protect personal information.The development of AI relies on its powerful algorithm and huge data support,which will constantly collect personal information and analyze,while individuals are maintaining their personal information rights.It is difficult to define the information that is infringed on the individual information,and the legal provisions of safeguarding rights are scattered,and the burden of proof is difficult.Drawing lessons from the decentralized legislation mode and self-discipline system in the United States,the European Union’s protection rules for data in the data field correspond to the protection of personal information rights in China.We can consider establishing a perfect system of personal information protection from legislation,artificial intelligence service providers,consumers,and market supervision.In addition to the introduction and conclusion,the paper is divided into four parts:The first part is a basic overview of personal information protection under the background of artificial intelligence.This part introduces the theoretical basis of civil law protection of personal information in the era of artificial intelligence,and the necessity and particularity of personal information protection in the era of artificial intelligence.It lays the theoretical foundation and realistic foundation for the analysis and solution of practical problems.The second part elaborates on the problems of personal information protection in the era of artificial intelligence in China,analyzes the feasibility of special legislation,the lack of users’ right to personal information processing,and the imperfection of the market mechanism of artificial intelligence services,with a view to laying the groundwork for solving pertinent countermeasures in the next step.The third part,from the perspective of learning and reference,studiesthe legislative mode of the United States and the European Union to deal with the protection of personal information in the era of artificial intelligence,and draws inspiration for our country’s legal system of personal information protection under the background of artificial intelligence.The fourth part,from the legal level,puts forward effective measures to perfect the legal system of personal information protection under the background of artificial intelligence,perfect the right of personal information processing of AI users,and establish the personal information security mechanism of AI market.
