Study On The Countermeasures Of Difficulty In Civil Service Of Grass-roots Courts In China

Service plays a connecting role in civil litigation.Therefore,it is in a crucial position and no other system can replace it.The improvement of the service system plays an important role in the advancement of the trial work.The grass-roots court handles most civil cases.Service occupies most of the judge's time and energy.In practice,difficult to serve has become a major problem that plagues the grassroots court.It is one of the constraints to improve the efficiency of trials,and it also hinders the exercise of litigant rights.According to the legal provisions and judicial practice,there are some problems in service system in China,such as the service provisions are not detailed enough,the service subject is not clearly standardized,the single provision of service location does not meet the actual needs,and the service responsibility is not perfect.After investigating the status quo of civil service in some grass-roots courts in western Inner Mongolia,it is found that there are some problems in the civil service of the grass-roots courts,such as weak service force,single location of direct service,lack of cooperation of the recipient,formalization of mail service,confusion of application of announcement service,low efficiency of transfer service,etc.It can be seen that the difficulty of civil service in China's grass-roots courts has not been really solved.The difficulty of civil service in China is caused by many reasons.It is mainly due to the incomplete service system,frequent flow of people,the lack of legal knowledge of the people,the court's service resources are not perfect,the number of civil cases has increased year by year,and the social integrity system has not yet been established.Through the comparative analysis of other countries' civil service system,the author summarizes their experience and provides reference for improving China's civil service system.By analyzing the situation and causes of difficulty in civil service,the author thinks that the service system can be reformed in many aspects,such as improving the system,perfecting the service management system of the court and following up the supporting measures.Specifically,it is necessary to take measures such as refining the service system,perfecting the existing service methods,clarifying the scope of service personnel,formulating detailed service procedures and strengthening the service configuration of the court,so as to improve the service efficiency of the court,and finally realize the smooth progress of civil litigation.
