Research On The Function Of Party Rules And Regulations

The Fourth Plenary Session of the 18 th Central Committee raised the emphasis on party rules and regulations to a new level,and incorporated the construction of party rules and regulations into the socialist rule of law system with Chinese characteristics for the first time.The 19 th National Congress of the Communist Party of China has elevated party rules and regulations to a more important position.The report states: ‘accelerate the formation of an internal party legal system covering all aspects of party leadership and party building.' This means that on the basis of perfecting the basic party rules and regulations,the central government has placed more emphasis on continuing to improve the party rules and regulations system to achieve full coverage of the system.At the Fourth Plenary Session of the 19 th Central Committee,the word ‘speed up' was used again to spur the work of perfecting the party rules and regulations system,which fully reflects the great importance and eager desire of the party's Central Committee to administer the country in accordance with the law and build China under the rule of law.Party rules and regulations are the sublimation of the party 's will to the system and rule of law through legal procedures.They restrict the actions of party members and party organizations through standardized expressions,and has become the legal basis for the party to govern the party and to administer the party strictly and rigorously.Only by clarifying the nature of party rules and regulations and grasping the value function of the party rules and regulations in the construction of the party and the rule of law,can the functions of party rules and regulations be truly realized,and the basic theory and value orientation of the party's rule of law and the state's rule of law can be established.Based on the general theory of party rules and regulations,this article defines the basic connotation of party rules and regulations and functions of them,analyzes the specific functions of party rules and regulations and how to play them,and combines the actual situation to summarize and restrict party rules and regulations.There are many factors in the function of laws and regulations.I put forward my personal opinions on the methods through which function can be stimulated to continue to be effective.With a view to forming apreliminary discussion on the functions of party rules and regulations,grasping the scientific connotation of the functions of party rules and regulations,clarifying which specific functions are involved,and working hard to implement functions in the process of building and implementing party rules and regulations.Thus,the strategic objective of comprehensively administering the country according to law and the strategic idea of strictly governing the party will be effectively promoted,the party's ability and level of governing according to law and regulations will be improved,and the level of rule of law in China will be improved.This article is divided into four parts.The first part is the basic definition of party rules and regulations and functions of them.First,the identification of the concept and attributes of party rules and regulations,that is,they have the characteristics of ‘law' and belong to a special ‘law',which lays the foundation for subsequent research.Secondly,it summarizes the development process of party rules and regulations,their development in different historical stages has their own characteristics,and builds the basis for the function of party rules and regulations under a systematic thinking.Thirdly,it introduces the connotation of the functions of party rules and regulations,and comprehensively positions the functions from the perspective of party building and rule of law.Finally,the research and grasp of the era demands of the functions of party rules and regulations have shown its special status in areas such as the construction of the rule of law in China,governance within the party,public governance,strict governance of the party,and comprehensive deepening of reforms.With a view to exploring the significance of the era when the functions were brought into play.The second part comprehensively and accurately elaborates the functions of party rules and regulations.First,it compares the functions of party rules and regulations with the laws of the country,and the two complement and promote each other.Although party rules and regulations have the attribute of ‘law',they show more special value than the laws of the country.Then they are subdivided into different areas,refining the functions of party rules and regulations into three major aspects: the function of instruction leading,the function of institution building,and the function of supervising officials.It sorted out and refined all aspects,and repositioned the functions of party rules and regulations from a systematic perspective.The third part focuses on the current realities,digs out the root factors that restrictthe effective functioning of the party rules and regulations,and analyzes them one by one from the three angles: the party rules and regulations system,the integration of party rules and regulations with national laws,and the ability to enforce party rules and regulations.The fourth part is to implement the practical issues,find out how to improve the functions of party rules and regulations,and from the perspective of the establishment of the system and mechanism,it will unify the system of party rules and regulations,realize the effective connection of the laws and the party rules and regulations,and enhance the ability to enforce party rules and regulations,and give full play to the functions of party rules and regulations.
