A Study On The Enforcement Of Labor Security Supervision In China

Labor security supervision is a consequent product,of market economy.Since the reform and opening up,China's economy has deeply developed.It brought at same time,a huge amount of labor relations.In order to implement the laws and regulations for labor security effectively,to ensure the legitimate rights and interests of workers be protected and for a well maintained labor market order,labor security supervision rised in the response of proper time and conditions.At the third plenary session of the 18 th central committee of the communist party of China(CPC),was requested,a strong promotion of modernization of the national governance system and the capacity.Meanwhile,especially in recent years,China has intensified its efforts to crack down on unpaid wages for rural migrant workers.For labor security supervision means all of those a more higher requirement of work load and quality.Combined with real example of labor security supervision in A city in Shanxi Province,this paper found situations and problems such as limited low-enforcement caused by low efficient tactics and measures;Loopholes of lows in enforcement processes;Ineffecient enforcement of inspector;not advanced law enforcement ways and so on.The reason is defined a not perfect system of laws and regulations,a not perfect organization of labor security supervision and its management,and In the process of handling cases especially under condition together work with other institutions,there may be unclear boader of responsibilitiy.The inspector team is also not yet mature.And it is also defined that the external environment of labor security supervision has a certain influence to it.In view of the above problems,the author puts forward below Suggestions.First,by correction of lows and regulations of labor security and increasing enforcement level of the relevant laws and regulations,to increase the cost of an illigal action for object unit.Secondly,to optimize organizationof labor security supervision institutions,build independent department of labor security supervision and management system.Third,the labor security supervision institutions and the labor arbitration institution should have an integration,in order to establish a multi-sectoral joined law enforcement process,against the difficulties in the process of reform of labor security supervision law enforcement.Fourth,strengthen the construction of labor security supervision team by strictly checking the admittance qualification of inspectors,supplementing the number of inspectors,and establishing a strict training system and accountability system.Fifth,strengthen the publicity of laws and regulations on employing units and workers,establish a fully functional labor security platform with big data used by the whole people,and improve the efficiency of labor security supervision and law enforcement.To sum up,through the writing of this paper,the author aims to provide reference opinions for the supervision and law enforcement of labor security in A city of Shanxi Province,and at the same time provide reference opinions for the supervision and law enforcement of labor security in other regions of China,so as to achieve the goal of fair,just and reasonable law enforcement and maintain social stability.
