In recent years,with the rapid development of urbanization in China,the demand for urban construction land has also increased dramatically.A large amount of collective land is requisitioned by changing the purpose and nature of agricultural land to meet the demands for urban construction.However,with the continuous rise of land value and the continuous advancement of collective land expropriation,the problem of corruption in land expropriation is particularly prominent,which not only has violated the legitimate rights and interests of landless farmers,but also has continuously devoured national assets,causing serious damage to local political,economic and social governance.This article takes the bribery crimes in the process of rural collective land expropriation and prevention measures as the research theme,combining the system's anti-corruption theory and the new public governance theory to build the analytical framework.The 306 rulings related to rural collective land expropriation and bribery crimes issued by the Supreme People's Court of China is the research object.Through text reading,the author encoded the information of each valid sample.This paper first conducts a descriptive statistical analysis on the corresponding variables.It is found that the high incidence of bribery crimes for rural collective land from 2007 to 2015 and most of the bribery criminals were male,the age of crime was concentrated between 31 to 50 years old,and most were front-line workers.Non-staff personnel,especially the staff members of the Village Communist Party Branch Committee and the Villagers' Autonomy Committee,has a higher crime of accepting bribes.Then the article explores the influence on the severity of bribery crimes from the identity characteristics of bribery criminals and economic and social factors.From the perspective of the identity of the bribery offenders,the higher the education level,the higher the severity of the bribery crime;the longer the incubation period,the higher the severity of the bribery crime.Non-staff personnel have a higher severity of bribery crimes than in-staff personnel.Grass-roots workers,especially those who work in the grass-roots mass autonomous organizations,are the "main force" in bribery crimes in the area of land acquisition.Combining the current situation of bribery crimes in the process of expropriating rural collective land,through the analysis of the operational logic of China's anti-corruption system and the in-depth analysis of the contents of 306 judgment documents,the article reveals the causes of the high incidence of bribery crimes in China's rural collective land acquisition from the dimensions of institutional factors,power system factors,cultural factors,and individual criminal factors.In order to effectively curb land expropriation and corruption,this article draws on the experience of Hong Kong and combines public governance theory to make policy recommendations including innovating rural grassroots governance mechanisms,improving the land expropriation system,strengthening the construction of anti-corruption systems,implementing precise measures by region,promoting big data to fight against corruption,improving the guarantee and incentive system,strengthening the education and training of integrity,and promoting public participation in the construction of integrity.
