Research On Public Participation In Local Legislation In China

In modern democratic countries,public participation in legislation is an important right enjoyed and exercised by citizens.The people being the masters of the country is the essence and core of socialist democratic politics.Adherence to the "mass line" in legislative work is not only an important embodiment of the concept of "legislation for the people" in practice,but also a powerful guarantee for the realization of the people's rights to be masters of the country.The 19 th National Congress of the Communist Party of China proposed "to perfect the system of people being the masters of the country and to develop socialist democratic politics." Compared with national legislation,the legal norms involved in local legislation are more closely related to the daily life of the public.As the public is paying more and more attention to their own political rights and the level of political participation is getting higher and higher,the local legislation has a close relationship with the vital interests of the public,which makes the public's desire for local legislation more intense.Although China has been studying the issue of public participation in local legislation for a long time,with the amendment of the Legislative Law in 2015 and the large-scale expansion of the subjects enjoying local legislative power,the problems arising from public participation in local legislation have also changed.Based on this,this article starts with the relevant concepts of public participation in local legislation,locks the mainbody of local legislation studied in this article as the local state power organ,and analyzes the characteristics of public participation in local legislation.After fully understanding the basic theory of public participation in local legislation and the current practice of public participation in local legislation in China,this paper selects Inner Mongolia Autonomous Region as an example to analyze the problems and causes of public participation in local legislation in China after the amendment of the Legislative Law.At present,the public participation in local legislation mainly faces the following problems: first,the system of public participation in local legislation is not perfect;second,the disclosure of legislative information is insufficient;third,there is a lack of response mechanism and evaluation mechanism;fourth,the public participation is not enthusiastic.Perfecting the relevant procedures of public participation in local legislation,perfecting the relevant mechanisms of public participation in local legislation,expanding the ways of public participation in local legislation,and increasing the enthusiasm of the public to participate in local legislation can solve the problems faced by the public participation in local legislation in a targeted way,and is also the necessary guarantee to ensure that the people are the masters and realize their political rights.
