A Study On The Civil Legal Issues In Online Third-party Payment

With the continuous development of network technology,the new mode of online third-party payment also begins to emerge.Through literature review and analysis,it can be seen that most of the current legal field studies the emerging mode of online third-party payment from the perspective of strengthening supervision,while there are relatively few rights and interests of consumers in the payment process.In this paper,on the basis of the current research field,the definite extension of research and innovation,this paper studies characteristics is to keep the consumers' rights and interests in the third-party payment for consumers is easy to cause the dispute focus of discussion and analysis on the legal issues,right,right of privacy and security,the right of fair trading right and claim for the basic theory of consumers' rights and interests,from the consumer rights and interests to the third party payment system and the practical level.Among them,most consumers use online third-party payment for transactions,so the number of infringements they encounter in the process of choosing online third-party payment increases constantly.However,when consumers are injured by infringement,they do not know how to protect their legitimate rights and interests through legal means.To sum up,paying attention to consumers' consumption rights and interests and creating a safe and legal payment environment can promote the effective and sustainable economic development,which is of vital significance for promoting social development and building a harmonious and stable consumption environment.To consumers as the research object,this paper USES the questionnaire survey,field investigation and literature research method,combining the investigation and the result data,through SPSS19.0 sorts through questionnaires and the survey data analysis,from the consumer in the process of third-party payment of tort,legal knowledge for consumer rights and interests,rights protection channels to master and use what way to maintain their legal rights and interests of consumer,etc to study the current status of consumer rights protection and found that the problems of consumer rights and law enforcement,Based on the research conclusion and the practical experience of the law of consumer rights and interests at home and abroad,this paper puts forward relevant Suggestions to improve the law of consumer rights and interests in the process of third-party payment from the perspective of legal system and consumers themselves.
