Study On Quantitative Methods Of Rule Of Law Evaluation

With the introduction of positivist research methods into the field of law,the research on the construction of the rule of law has gradually turned from theory to practice.In the ongoing practice of rule of law evaluation,the theoretical and practical circles focus more on the study of relevant theoretical issues such as rule of law index design,but seldom on the inherent scientific issues of the quantitative method of rule of law evaluation with obvious technology.As a powerful tool,the quantitative method of rule of law assessment almost runs through the whole process of rule of law assessment.However,as a new thing with a short time,the definition of the quantitative method of rule of law assessment is still relatively vague.Only when the orientation and utility of the quantization method are clarified,can the function,choice and application of the quantization method be better grasped.The quantitative method of rule of law evaluation is an important content of social science law theory,which should adhere to the positivism research and gradually clarify its effectiveness in the process of trial and error,to enrich and improve the rule of law evaluation methodology system.This article is divided into five chapters.In the first part,the author introduces the source and significance of the topic.The current status of quantitative methods of rule of law evaluation at home and abroad is analyzed.Then,the shortcomings of the current research and the problems that attempts to demonstrate in this article are pointed out.The second part,the rule of law evaluation of the quantitative method of the overview.Due to the short time and low frequency of the concept of quantitative method of rule of law assessment,At the same time,the concept of quantitative method is not clearly defined.The first part of this paper introduces the types of quantitative methods,explains the practical requirements of quantitative methods of rule of law evaluation,and analyzes their necessity and localization,which lays a foundation for the study of quantitative methods of rule of law evaluation.The third part is the practice exploration and existing problems of the quantification method of rule of law evaluation in China.To explore the rule of law to evaluate quantitative method in yu hang system,Beijing system ? two typical practice systems based on the application,such as quantitative methods are summarized the rule of law in our country appeared in the process of evaluating quantitative computation process barriers,quantitative process lack of open,the lack of credibility and so on.The fourth part is the practice of quantitative method of rule of law evaluation abroad.By studying the practical experience of the quantitative system of rule of law assessment with wide influence,such as "the world bank's global governance index(WGI)","world justice engineering index(WJP)".This paper explores the quantitative theory and method used in the process of rule of law indexation,and provides experience for the improvement of the quantitative method of rule of law evaluation in China.The fifth part is the path to improve the quantitative method of rule of law evaluation.In view of the problems existing in the quantitative method,the corresponding rationalization suggestions are put forward from methodology,operation mechanism and other aspects on the premise of adhering to the positivist point of view.Quantitative methods is not only a tool,but also as a way of thinking to measure the rule of law.The ultimate purpose of the research on the quantitative method of rule of law evaluation is to enable the quantitative data to reflect the objective and true level of rule of law,so as to promote the healthy development of the rule of law in China.
