Study On The Construction Of The Hierarchical Intervention System Of Juvenile Delinquency

With the juvenile delinquency becoming more and more younger,even serious violent crimes are frequently seen in the newspapers,which makes the regulation of juvenile delinquency become increasingly serious social problems.However,in practice,"let it go" or "one sentence" often occurs.How to intervene in time according to the severity of their behavior has become an urgent problem.With the "2018-2022 procuratorial reform work plan" issued by the Supreme People's Procuratorate at the beginning of 2019,which puts forward the system of "exploring the establishment of critical education,family education,hierarchical treatment and protection punishment for minors with criminal mistakes",it is more necessary to provide theoretical evidence for the system construction of hierarchical intervention for minors with criminal mistakes.Based on the analysis of the current situation of the classification intervention of juvenile delinquency and misdemeanor in China,it is found that there are four major problems in the current classification intervention of juvenile delinquency and misdemeanor in China,which are binary separation,development imbalance,connection fault and insufficient supporting.The basis of the hierarchical intervention system of juvenile delinquency includes theoretical basis,practical basis and social basis,all of which provide the feasibility support for the construction of the system.The concrete construction of the grading intervention system of juvenile delinquency and wrong behavior should be based on the grading of core elements,logical structure and specific consideration factors: the grading of core elements includes the grading of applicable objects,delinquency and wrong behavior,and intervention measures;there is a corresponding logical structure of dynamic circulation between delinquency and wrong behavior and intervention measures;the most basic consideration of selecting and applying specific intervention measures The factors are the age and nature of the actor.The classification and intervention system of juvenile delinquency is also a systematic project,which needs to improve the corresponding legislation,department connection,specialized agencies,social support system and other supporting mechanisms and measures,so as to realize the function preset of theclassification and intervention system of juvenile delinquency.
