Legal Guarantee Of User Security Under Sharing Economy

The development level of China's sharing economy is in a leading position in the world.At present,the sharing economy model not only changes people's traditional consumption concept,but also fully and effectively develops the application potential of relatively idle resources in the society and fully reduces the waste of existing resources.Therefore,it is of practical value and theoretical significance to study the legal guarantee of user security in the sharing economy.The main purpose of this paper is to solve the problem of legal protection of users in the sharing economy.In order to define the concept of sharing economy,we should consider both the influence of the core elements and the general understanding of the market.Based on this,the sharing economy can be defined as a pattern of idle resource allocation realized by "sharing" based on the sharing platform.Secondly,we should make clear the type of sharing economy.Based on the definition of the concept of sharing economy,the sharing economy is usually represented as a C2 C model between providers,platforms and consumers.Finally,in order to ensure the legal protection of users,it must be clear what legal subjects participate in the sharing economy model.We can roughly divide the main body involved in the sharing economy itself(i.e.the legal body involved in the internal legal structure of the sharing economy model)into three main bodies: the supply side of goods and services,the demand side,and the sharing economy platform.From the perspective of external legal structure of the sharing economy model,in addition to the competition with similar enterprises in the sharing economy model,it is also of great significance for the security of users to attach importance to the supervision of new things by government regulatory departments.Sharing economic model is a new business model,and relevant regulations of the legal lag,make the law can not be fully effective adjustment of the new economy,this is particularly reflected in the use and protection of user information sharing economy,due to the leakage of personal privacy information such as user,causes the user in terms of personal and property are violated;As a new economic model,the legal status of users and sharing platform is not well grasped,and the government's supervision of sharing platform is also difficult.In addition,there are also large transaction default risk and lack of protection of users' trust interests,which are the security problems users are facing.Facing the legal difficulties related to user safety in the sharing economy,this article will start from the concept of the sharing economy,clarify the scope of the sharing economy model,and then analyze the characteristics of the legal subjects participating in the sharing economy model.Then,it will be exposed in practice in combination with the sharing economy model.For the typical problems of user protection,the relevant legal suggestions to protect user safety are put forward.
