In recent years,a sharing economy enterprise represented by Airbnb,Eatwith,Network car and Everyone loan are rising rapidly around the world.The sharing economy is different from the traditional economic model,it has an innovative and unique operational mechanism and trading structure,and affects and changes people's work and life style.To a certain extent,the sharing economy has an impact on traditional economic industries.Therefore,the study of the sharing economy model has realistic value and epochal significance.As a market innovation,the sharing economy emphasizes the participation of everyone and the sharing of business.However,in such a market innovation,Because of its immature development and relative lagging law,there are existing problems in the existing system,such as the lack of relevant market access system,the boundary problems facing market access,and the outstanding phenomenon of unlicensed management,the incompatibility of new and old business models.The material base determines the superstructure,But if the superstructure is suitable for the development of social economy,it will promote the development of material in turn.At present,the problems arising from the sharing economy industry show that the legal system of sharing economy is still not perfect and can not meet the needs of the continuous development of its industry.And the market access system is the core of the legal system of sharing economy supervision.To reform the industry of sharing economy,we must first reform the market access system,that is,the top-level legal regulation of the industry.Therefore,through the analysis and sorting out the legal regulation of the market access of the sharing economy,this paper points out its existing problems,and drawing lessons from the foreign experience,I hope to put forward some constructive suggestions to improve the legal regulation of the market access of sharing economy in China,so as to promote the development of China's sharing economy reform.The full text is divided into four parts:The first part introduces the basic theory of the legal regulation of the market access of the sharing economy.First,we define the concepts and characteristics of the sharing economy,and then define the scope and form of the continuous expansion and innovation of the sharing economy,through the comparison of the access of the sharing economy and the traditional economic market,it leads to the necessity of the legal regulation of the access of the sharing economic market,and lays a theoretical foundation for the analysis below.The second part introduces the problems in the existing system,such as the lack of relevant market access system,the boundary problems facing market access,and the outstanding phenomenon of unlicensed management,the incompatibility of new and old business models,and analyzes the reasons,so as to put forward the corresponding solutions,and it lays the foundation for analyzing the legal regulation reform of the market access of the sharing economic sector.The third part introduces how the European Union,California and Singapore regulate market access in the relevant sectors of the shared economy.Combined with China's current system and actual situation,it use the experience of other countries for reference,such as the special license system in the United State and the unified administrative license in the European Union mode.So as to draw the benefit of China's legal regulation of market access to the sharing economy.The fourth part,in accordance with the existing problems of market access under the sharing economic mode,makes perfect suggestions.In order to promote the healthy development of the sharing economy,we should formulate and improve the threshold and rules of market access for shared economy,clarify the boundary issues,carry out the boundless jurisdiction of the registration jurisdiction and adopt different regulatory policies.
