The Challenge And Countermeasure Of Artificial Intelligence To Law

The mysterious veil of artificial intelligence(AI)is gradually unveiled.Intelligent products are integrated into the production and daily life,blurring the boundaries between non-living bodies and living bodies,drawing out legal,security and ethical issues.On the one hand,weak AI has gone beyond all kinds of technical nodes and promoted the advancement of human civilization.It even appear to defeat the top honor of mankind in the special field.On the other hand,scholars and people around the world have raised various concerns about the unpredictability of AI.How can we break through the technical difficulties in the field natural science and open the "black box" of AI? How to use this technology rationally and scientifically? How to control artificial intelligence to benefit human development is not only a topic of computer and mechanical disciplines,but also a topic of interdisciplinary subjects such as biology,ethics and law.Recently,some first-tier countries is also calling for the legislation of AI-related field,and also have issued strategic policy reports on the development of AI.In 2017,the IEEE(Institute of Electrical and Electronic Engineers)also issued the standards for the development of artificial intelligence,which indicated the attitude to the international academic community.AI technology attaches an unprecedented challenge to the legal system and legal rules worldwide,conflicting with existing legal systems in many aspects.The defect of the lagging legal system has been exposed to the public again,putting urgent questions for both the society and the legal person.For the negative impact of AI on modernity,it is necessary to adopt preventive behavior and adaptive systems to deal with risks.On the premise of summarizing the problems caused by AI,this paper adheres to the principle of the subject-object two-point method of civil law and the basic principles of criminal law,making a jurisprudential analysis of the causes of the problems,leading to the corresponding strategies.Human beings should appropriately adjust the normative system in the future,taking the controllable development of artificial intelligence as the requirement,establishing a social normative system that takes people and nature as the value goal,ethics as the guide,technology as the basis,and law as the rule.Timely formulate AI ethical regulations,scientifically supervise the research and the use of AI and introduce artificial intelligence laws and regulations.
