In practice,there are many cases of social panic caused by the widespread spread of false food safety risk information.In order to maintain the stability of food market order,The Food Safety Law of the People's Republic of China(hereinafter referred to as the Food Safety Law)revised in 2015 proposes to establish a food safety risk exchange system in China.In order to solve the market failure caused by information asymmetry between market entities,and to safeguard the public interest.However,the system is still in the initial stage of development in China,and it lacks the necessary legal norms in the operation process.The right to know and participation of market participants represented by consumers has not been effectively guaranteed.In order to speed up the construction of the system,this paper studies and discusses the food safety risk communication in China from the perspective of economic law.The full text is divided into the following five parts:The first part: Introduction.This section mainly introduces the research background and the meaning and significance of the selected topics,and domestic and foreign research.The second part: Overview of Food Safety Risk Communication System.In order to distinguish the research of public management and food safety and nutrition,this paper defines the connotation of food risk and food safety risk communication system from the perspective of economic law.Explain the legal relationship and characteristics in the food safety risk communication system.Theoretical support for food safety risk communication system based on market failure theory,consumer knowledge theory and risk prevention theory.The third part:The status quo and problems of China's food safety risk communication system.This part summarizes the problems existing in the legislative system and legal system construction of China's food safety risk exchange system from the status quo of legislation and implementation status.For example,the legal system is incomplete,the communication subject is incomplete,the scope of communication is not uniform,the communication method is unilateral,the legal effect is unknown,and the guarantee system is lacking.The fourth part: Investigation and reference of foreign food safety risk communication system.This section examines the practices and experiences of the EU region,the United States,and Japan in the construction of food safety risk communication systems.And to provide reference for the improvement of China's food safety risk exchange system.The fifth part: Suggestions on the improvement of China's food safety risk communication system.First,in terms of the construction of the legal system,it is proposed to formulate measures for the management of food safety risks and raise the level of relevant legislation.Second,in terms of communication subjects,the public is given the qualifications to participate in risk communication.Third,in terms of the scope of communication,the criteria for judging food safety risk information are clarified,and food safety standards are included in the scope of risk communication.Fourth,in terms of communication methods,the public participation right is realized from the aspects of accelerating the construction of a unified food safety information platform and innovating the public participation mechanism.Fifth,in terms of the legal effect of communication,it is proposed to clarify the legal effect of public opinions and strengthen the government's response obligations.Sixth,in the aspect of guaranteeing the relief system,it is proposed to improve the food safety public interest litigation and standardize the reporting system for food safety violations.
