The Case Study Of Perfecting "De Gu" Mediation In The Yi Nationality Area Of Leshan City

There are a large number of traditional ways and means of mediating civil disputes in C hina,which are called customary law from the perspective of law.The customary law of ethnic minority areas plays an important role in solving civil disputes.However,under the background of the construction of modern legal society,the applicable rules in the mechanism of solving civil disputes need to be further standardized.Its operation rules,procedures and methods need to be clear and standardized according to the development of the times and the background of modern legal construction.Therefore,standardizing and guiding the application of customary laws and cultural traditions in ethnic minority areas can fully reflect the respect for the traditions and cultures of ethnic minority compatriots.It also plays an important role in promoting,the social and cultural development and legalization of ethnic minorities,and is conducive to improving the level of grass-roots governance in ethnic minority areas.Combined with the reality of social governance in ethnic minority areas,Nlabian Yi Autonomous County and Ebian Yi Autonomous County in Leshan City,under the premise of adhering to the rule of law,actively explore new ways to solve social conflicts and disputes,launch and implement a new "de Gu mediation" work method,and successtully resolve a large number of social conflicts and disputes.In the Yi District of Leshan City,a multiple+autonomous dispute mediation mode and social governance mode has e been formed.a front-line fortress for poverty alleviation has been built,the work efficiency of tareted poverty alleviation has been improved,and a solid foundation has been laid for the social governance system based on the "de Gu mediation".Meanwhile,the new social style and social fashion in ethnic areas have been purified and standardized.and significant governance achievements hav e been achieved?The significance of the "de Gu mediation" discussed in this study in Leshan Yi area is not to advocate replacing the national law with the habits of ethnic minorities,but to focus on how to eliminate the rough and extract the fine,and to use the traditional social resources of "de Gu mediation" to serve the current social governance and the construction of the rule of law."Do Gu mediation" has existed for thousands of years in the cultural tradition of the Yi people,and it stilll plays an important role today.In response to this reality,Leshan City has made perfect actions on the basis of the existing "de Gu mediation".In view of the inherent disadvantages of "de Gu mediation",such as the imbalance of common law and national law in the process of mediation implementation,the backwardness of mediation methods,and the poor quality of mediators,etc.The Yi District of Leshan City has achieved fruitful results by optimizing and improving the de Gu mediation" mechanism,carrying out the organizational construction of the mechanism,the reconstruction of mediation workflow,and improving and standardizing the mediation methods.This paper makes an in-depth study on the improvement of the system and mechanism of "de Gu mediation" in Yi District of Leshan City.Through investigation,it is found that there is still room for optimization in the reform of the mechanism of "de Gu mediation" in the construction of "de Gu" team,the standardization of the scope of"de Gu mediation" and the mutual promotion and complementation of national law and customary law.Through the research,it is concluded that "de Gu mediation" must be carried out under the leadership of the party,must be based on the premise of protecting the people's rights and interests,must adhere to the combination of France and Germany,must adhere to the case enlightenment of advancing with the times.The purpose of this study is to provide a more comprehensive reference and inspiration for the social governance,the applicable rules and regulations of mediating social disputes,and the construction of the rule of law for the "de Gu mediation" and even the folk law in the ethnic minority areas.
