Research On Public Participation System In Major Administrative Decision-making

The study of the public participation system in major administrative decision-making is not only of great significance in the study of administrative law,but also of practical significance in promoting the construction of the rule of law in decision-making.However,from the legal texts and case analysis in practice,the construction of public participation system in major administrative decision-making in China is obviously unsatisfactory.In this paper,the theoretical and practical problems of the system are analyzed,and corresponding suggestions are put forward to improve the system.The first part elaborates the significance of public participation in major administrative decision-making.To fully explore the important role of public participation in the formulation,implementation and implementation of major administrative decisions,as well as the positive impact on the protection of citizens' rights and interests and the development of democratic politics in China.The second part combs the current situation of policies,laws and regulations related to the system in China,and combines the latest typical cases to analyze and summarize the main problems in the public participation system and system practice of major administrative decision-making.There are some problems in the public participation system and practice of major administrative decision-making in China,such as unclear participants,lack of feedback system,single mode of participation and imperfect hearing system of major administrative decision-making.The third part discusses the basic principles of public participation in major administrative decisions.Public participation in major administrative decisions should follow the principles of legalization of scope of matters,effectiveness of representation of opinions,consistency of powers and responsibilities of decision-makers and universalization of public hearings.The fourth part analyses the stages and ways of public participation in major administrative decisions.Public participation in major administrative decision-making should be a full process of participation.In the three stages of major administrative decision-making,namely,the goal-setting stage,the agenda-setting stage and the final scheme-selecting stage,full public participation should be carried out.Because of the complexity of major administrative decision-making,different ways of participation should be determined according to different types of participation in each stage,and the ways of participation such as public opinion survey,public opinion consultation,Symposium and hearing should be combined and applied.The fifth part is based on the practical dilemma of the public participation system in major administrative decision-making in China.It puts forward the measures to improve and perfect the system,and concludes that the fundamental solution lies in the continuous improvement and innovation of the top-level system design.To improve the system of public participation in major administrative decision-making in China,we should improve the selection mechanism of public participation representatives,follow up the feedback mechanism of public participation,improve the hearing system of major administrative decision-making and expand the ways and channels of public participation in major administrative decision-making.
