The public participation in administrative decision-making is those behaviors that refer to the administrative authority ask for information and opinions from the public and of the interested persons or organization in order to enact an administrative decision-making. Public participation in administrative hearing is a necessary requirement of the countries’democratic administration and the core requirements of modern procedural law. It also is the most important channel for the public to participate in the administrative decision-making process. Introducing the hearing system into the administrative decision-making can promote the governments to make a more democratic and scientific policy and to improve the ability to execute policy. At the same time it can reduce the execution resistance to maintain fairness and justice and normal social order. Premier wen jiabao’s government work report in2006said the government should insist for a long time to democratic and scientific decision-making. Government policy should be appropriate to introduce the mechanism of public participation, in-depth research before making decisions and widely listen to the opinions of the public, and to ensure that the correct scientific decision-making. At the same time, it should also be as a long-term system of our government has always stick to it. And35years of reform and opening-up, constructive, public participation in legislation and policy.Therefore, public participation in administrative decision-making legislative hearings need more protection of law and the support of system. Since1996the "PRC Administrative Punishment Law" provided the administrative hearing process, the depth of the administrative hearing system has had a great development in depth breadth and operability. And with the change of the society and democratization developing worldwide, there are many problems to be perfected in the hearing system. This paper attempts to analyze the hearing system of administrative decision-making from the perspective of public participation, find the direction to make improvement, and make some recommendations. |
