On The Protection Of Residential Viewing Interests

With the progress of social material economy and the development of human civilization,people begin to pay attention to the external conditions related to spiritual life as well as the cure of material living conditions.In recent years,disputes over the right to overlook emerge in an endless stream,which is a reflection of people's spiritual needs in the new stage of social development.Therefore,it is also of positive significance to discuss the residential overlooking interests in depth nowadays.This paper intends to understand the connotation,nature,protection value and current protection status of the residential overlooking interest,with a view to putting forward suggestions for its protection.This article will use case analysis,value analysis,literature analysis and other methods,starting from the actual cases of disputes over residential overlooking interests,summarize the existing problems in the protection of residential over looking interests in judicial practice,carry out value analysis on residential overlooking interests,clarify the current legislative status of residential interests protection in China,and further introduce the protection of residential overlooking interests in China.Based on the analysis of the connotation of environmental rights and interests and the form of environmental hazards,the author considers that it is more appropriate to define the residential overlooking interests as environmental rights and interests.Combining with the practice of protecting the obligatory interests of Japan and some European countries,the author puts forward some countermeasures to improve the protection of residential overlooking interests.
