Discussion On Perfecting The Environmental Accountability System Of Our Government

At present,due to the deterioration of the ecological environment,more and more people have to pay attention to environmental problems.In order to solve the environment problems,we must accelerate the progress of technology and the innovation of ideas,besides,it is more important to realize the government's commitment to environmental responsibility.As the main body of environmental protection,the government should actively carry out environmental responsibility and bear environmental consequences in the environmental protection work.However,in recent years,the reasons why the number of the environment incidents increased gradually because the government and the staffs' inaction and improper measures to solve these environmental problems.So it's a current issue to be worthy of discussing about how to restrain the government's power and hold the government to take its improper responsibility through some legal liability mechanisms.China has enacted a number of laws and regulations which related to environmental protection and adopted several international environmental treaties.However,problems such as environmental management model lag,environmental law enforcement is not in place,environmental accountability effectiveness are still exist.Although the causes of the environmental law effect is not ideal in many aspects,but the most fundamental reason is the legislative level of government environmental responsibility provisions of the lack,especially lack of government regulations and the secondary responsibility,the specific performance of environmental accountability system is not perfect.The Responsiveness is an important attribute of the responsible government,the accountability system is a significant performance of government response,the government environmental accountability system plays an irreplaceable role in the implementation of government environmental responsibility,effective accountability mechanism can reduce the possibility of the occurrence of the phenomenon of lack of government environmental responsibility.At present,China's environmental accountability is in its infancy,there are many gaps in legislation,the existing laws and regulations are not operational enough.In practice,the accountability system does not reflect its due value,and fails to give full play to the supervisory role of the system itself in the environmental responsibility of the government.Therefore,in order to improve environmental conditions,coordinate the contradiction between economic development and environmental protection,and to meet the growing public awareness of the environment,it's important to improve and perfect the responsibility of government in environmental protection and the government's environmental accountability system.This paper intends to start with the present situation of environmental accountability in our country.This paper analyzes the problems existing in the practice and legislation of environmental accountability in our country by expounding the theoretical basis of environmental accountability,the relevant laws and regulations,the convergence system and supporting provisions and trying to find a way to consummate the legal path of government accountability system in the light of the experience of ecological accountability in other countries.In addition to the introduction,this paper consists of five parts:The first part analyzes the legal analysis of the government environmental responsibility,starting from the concept of responsibility,analyzing the value of perfecting the government environmental responsibility,and pointing out the present situation of the lack of environmental responsibility of government.The second part expounds the theory of government environmental accountability,defining the basic concept of accountability,introducing the theoretical basis of accountability,the relationship between the government environmental accountability,the relationship between accountability and audit,the theoretical background of environmental audit and the important value of audit as accountability information guarantee mechanism.The third part discusses the defects of the government environmental accountability in China,mainly analyzing the lack of accountability concept,legal provisions and accountability mechanism.The fourth part discusses the western government legislation on ecological accountability and the enlightenment to environmental accountability in China.The fifth part discusses the legal way to improve the government environmental accountability mechanism,including changing the concept consciousness of government environmental accountability,strengthening the government environmental legislation,constructing multiple accountability mechanism of government environmental responsibility,perfecting the government environmental auditing and perfecting the information disclosure system.
