Research On The Economic Law Regulation Of "Net Cars"

In 2018,the size of China's sharing economy transactions reached 2.942 trillion yuan,of which the transportation sector accounted for 247.8 billion yuan.From 2015 to 2018,the online transportation industry contributed 1.6 percentage points to the overall business growth every year,and the penetration rate of online ride-hailing users reached 43.2% among netizens.Through the data,we can find that,with the advent of the Internet,in the big data,high and new technology such as GPS,driven by Shared economic rapid growth in the field of transportation in recent years,network information about car is based on large data,GPS and other advanced technology development of the product,in promoting the service industry structure optimization and the way of travel consumption plays a more and more important role on the transformation.On the other hand,as the main representative of innovative industries,e-ride-hailing has brought huge impact on the traditional industry.While promoting the reform of the traditional industry,it has also brought some competition problems.In addition,some problems of the development of the emerging industry have gradually emerged.Therefore,in order to maintain the sustainable momentum of the emerging industry and promote the standardized development of the e-ride-hailing industry,this paper analyzes the current problems of e-ride-hailing,and puts forward Suggestions for the regulatory deficiencies,so as to overcome the current obstacles of e-ride-hailing and better serve the public.Current sharing in our country economic development momentum,the net about cars in a rich way people travel,has contributed to improve social idle resource utilization,at the same time,the competition of market chaos,bad effect of malignant events,the consumer rights damage after relief,and so on and so forth,regulation measures taken by the government in different stages practice effect is not ideal,some even continue to use the management mode of the taxi,it is difficult to achieve the goal of truly effective management.Based on this,this article is divided into four chapters,the introduction mainly introduced this article selected topic background and the research status of networkaround the car,the first chapter introduces the basic theory about network about cars,including the meaning of network about car,operating model and characteristics,this paper summed up the net operating mode about taxi,lift,car models and express,about car body for network involves complex legal relationship(mainly expounds the labor relationship,intermediary relationship and employment relationship three different theories)are mainly elaborated in this section;The second section mainly explains the necessity of the regulation of online ride-hailing under the influence of market competition disorder and mainstream consciousness of standard development.The second chapter mainly introduces the legal regulation status and predicament of China's ride-hailing market.In terms of the regulation status,it mainly compares the implementation methods of the central government and the local government.The regulation dilemma is mainly reflected in three aspects: the deviation of regulation concept and tolerance and prudence,the controversial definition of legal responsibility of online car-hailing trading subjects,and the difficulty in protecting consumers' rights and interests.The third chapter mainly introduces the regulation experience of the United States and the United Kingdom.Fourth chapter network practical problems about the car industry in China,using the experience of other developed,put forward the three-dimensional supervision mode,promote the establishment of network about car form a diversified,systematic Suggestions of regulating mechanism,the author believes that we should stick to encourage innovation network about car regulation principle,to "government+ enterprise" new mode of cooperation,give full play to the government,platform,enterprise,industry association's function,work together to realize the coordinated regulation of internal and external,mutual benefit and win-win results.To be specific,we need to strictly implement the e-commerce development law of the People's Republic of China,further clarify the main responsibility of the platform,emphasize its review obligation,and divide the responsibility according to the principle of fairness.Secondly,we can strengthen the protection of consumers' rights and interests through the timely implementation of information disclosure obligations on the platform,the introduction of insurance relief channels,and the promotion oftechnological innovation.
