Research On Legislation Of Environmental Pollution Liability Insurance In China

With the rapid development of our country's economy,environmental problems have become increasingly prominent.The continuous occurrence of environmental pollution accidents has brought serious economic losses to our country,and the huge amount of compensation for environmental pollution damages have caused many polluting enterprises to be overburdened.Environmental pollution liability insurance is an effective measure to solve the problem of liability for damages after environmental pollution accidents.Environmental pollution liability insurance enables the victims to obtain reasonable compensation in time after the actual occurrence of environmental pollution accidents,disperse the risk of environmental pollution for enterprises,and reduces the pressure for the government.It will also indirectly play a role in reducing environmental risks and preventing environmental pollution accidents,thus contributing to our country's environmental protection.This paper mainly focuses on the legislation of environmental pollution liability insurance in our country.Based on the analysis of legislation and practice of environmental pollution liability insurance at home and abroad,this paper constructs the legal system of environmental pollution liability insurance in our country,and puts forward some suggestions on insurance mode,insurance coverage,insurance institution,rate determination and liability limitation in the future legislative process of environmental pollution liability insurance,so as to improve the legislative content of environmental pollution liability insurance in our country.Only by perfecting the environmental pollution liability insurance system of our country through legislation,standardizing and guiding the procedure of insurance through law,and gradually solving the problems arising in the process of development,can we more effectively play the important role of environmental pollution liability insurance in dispersing risks,relieving victims and protecting the environment,thusimproving the serious situation of environmental pollution in our country.
