Research On Legal Governance Of Internet Rumors

The birth and development of the Internet technology,which has greatly influnced and changed the way of people's lives,has provided convenience for the acquisition and dissemination of information.But with the randomness of dissemination information,the problem of Internet rumors is becoming more and more serious.Unlike traditional rumors,online rumors has the characteristics of anonymity of the person,high speed and a wide range of transmission,a large number,and it is also difficult to distinguish between true or false.Therefore,comparing with the traditional one,it can cause much more harm and it can also bring bad influence on our lives,society and even the country.In China's legal regulation of the Internet rumors,there are still disadvantages such as incomplete legal regulations and incomplete law enforcement mechanisms.So it is pressing to improve the legal governance of the Internet rumors.This article will introduce the elaboration of the basic concept of the Internet rumors,besides this,it also introduces its characteristics and the necessary to regulate the Internet rumors,and analyzes the deficiencies from the status quo of the legal regulations governing Internet rumors in China.After analyzing and summarizing the experience of the Internet rumors legal governance in foreign countries,then draws on some lessons and puts forward some suggestions for the law governance of the Internet rumors in China.This article is divided into four parts.The first part is an overview of the Internet rumors.It shows the concept,legal recognition standard,classification and characteristics of Internet rumors,and the necessity of regulating the Internet rumors.The academic definition of the concept of the Internet rumors can be divided into broad sense and narrow sense.Harmful internet rumors not only affect personal reputation,bring personal economic loss,but also cause social disorder.The spread of internet rumors causes great harm to the individuals,society and country.The second part is a survey to the legal governance of the Internet rumors in China.Analyze the current status of the legal regulations governing online rumors in China,and point out the deficiencies of the legal governance of online rumors in China.Based on this,the legal system for regulating online rumors is incomplete,the law enforcement mechanism is not complete,and the mechanism for accountability for Internet rumors,either.The third part is the investigation and enlightenment of legal governance of extraterritorial network rumors.Introduce and analyze online rumor governance in five countries—— the United States,Germany,South Korea,the United Kingdom,and India——and draw lessons from their governance experience for reference.The fourth part is to improve the legal governance of the Internet rumors in China.From the four levels of legislation,law enforcement,justice,and society,we make suggestions for the legal governance of the Internet rumors in China.It is proposed to improve the network rumor legal governance system and network rumor governance implementation mechanism,strictly sentencing and convicting at the judicial level,and strengthen the self-discipline mechanism to improve the efficiency of the management of network rumors.
